Record note on the meeting of Joint Committee on MACP held on 15.03.2011



The subcommittee constituted by the National Anomaly Committee to go into the anomalies in respect of MACP issues met at New Delhi on 15th Inst. Com. S.K.Vyas, President, Confederation attended the meeting as a member. The following is the outcome of discussion at the meeting.

Given below is the Record note on the meeting of Joint Committee on MACP held on 15.03.2011.

The third meeting of joint committee on MACP was held today i.e 15.03.2011. This meeting was held at the specific request by the Secretary Staff Side, National Council JCM to review the decision taken in the earlier meetings in which all items had been discussed.

Item Nos. 1,3,8,9 and 29:
Grant of financial up-gradation in the promotional hierarchy instead of grade pay hierarchy under MACP Scheme
      The Staff Side pressed this demand on the ground that the ACP 1999 had become a service condition in respect of all those who were in service as on 31st August 2008. The MACP Scheme being less advantageous could not be imposed upon them. They stated that to resolve this anomaly, the first 2 ACPs may be continued in the promotional hierarchy to be granted after 12 and 24 years of service from the date of induction, the third ACP on completion of 30 years service may be in the grade pay hierarchy. The official Side did not agree with this proposal. The Staff Side then pointed out that the introduction of MACP Scheme in grade pay hierarchy 10, 20, 30 years of service from the date of induction will result that certain cadres would be placed in the grade pay which are not sanctioned in the structure of the departments and therefore it can not be treated as career progression at all. The official Side wanted the particulars of those cadres which are going to face this problem, so that they could consider how to overcome such anomalies. The Staff Side agreed to provide the necessary information and departments concerned may also be asked to provide such information.

Item Nos. 2, 10 and 48:
      The Staff Side also pressed for introducing MACP Scheme with effect from 1.1.2006 so that those who did not get any benefit under old ACP could atleast get the MACP scheme benefit before their retirement during the period from 1.1.2006 to 31.8.2008. The Official Side stated that this item has been closed and concluded and can not be allowed to be opened / reviewed. The Staff Side then stated that they would like to raise this issue in the meeting of National Anomaly Committee as the joint Committee on MACP Scheme is sub committee of the National Anomaly Committee. The Official Side stated that this may be raised as afresh item in the National Anomaly Committee.
The Staff Side also wanted that the option to choose ACP or MACP should be given to the individual employees and not the Department. The Official Side also did not agree to reopen this issue which has been concluded in the last meeting.

Item No. 57:
Ignoring the placement of Artisans of Ministry of Defence from HS grade II to HS grade I for the purpose of MACP Scheme.
      The Staff Side pointed out that this restructuring by keeping 50% of Artisans in the HS grade I and placing 50% in the HS grade II was by way of placement and therefore it could not be treated as promotion. The Staff Side cited Supreme Court ruling to this effect. However the Official Side did not agree with this. The case of restructuring in IA & AD in 1984 and in organized accounts were also cited in which it was clearly stated that those who are in the higher grade would be treated as placement only those who are promoted later on against vacancies would be treated as promotion. The official Side view was that only in those cases where the entire cadre is placed in the higher pay scale it would not be treated as promotion. This matter will also have to be raised in the meeting of National Anomaly Committee.

Items Nos. 11, 15, 22, 39, 47 and 51:
Promotion in identical Grade Pay.
      The decision that the normal promotions are in the same grade pay, they cannot be ignored for purpose off MACP Scheme and the specific cases would be examined separately.

Item Nos. 12, 30 and 49:
Employees appointed limited competitive examination from lower to higher post may treated as direct recruits in the higher post ignoring the service in the lower posts.

      The matter is still being considered with reference to old ACP scheme clarification.

Item Nos. 13, 32, 38, 44, 50 and 58:
Counting of old service in the new establishments for the purpose of MACP and
Item Nos. 21, 27, and 28:
Benchmark for financial up gradation under MACP.

      Orders have been issued on 1.11.2010.

It was agreed that action taken statement would be finalized and circulated so that further discussion thereon can take place in the meeting of National Anomaly Committee.

Govt should consider the grant of MACP at least to the employees who were in service between 1 Jan 2006 and 31 Aug 2008 as one time measure. The serving employees already got the MACP wef 1 Sep 2008 whereas the employees who were eligible for MACP but retired from service during the said period were denied the financial benefit of MACP. The matter should be taken with the Govt in proper manner

Sir,
the demand of first 2 ACPs may be continued in the promotional hierarchy to be granted after 12 and 24 years of service from the date of induction, the third ACP on completion of 30 years service may be in the grade pay hierarchy shold be accepted by the Official side. Why they are not accepting, it clearly shows how the anamaly committee is so neglent towards the lower staff (like GP of Rs.1900, 2000, 2400 and 2800. It is better to cancel the MACP scheme and restore the ACP as such. The anamoly committee is making injustice towards the lower staff.

In Ministry of I&B,in departments like Films Division etc., the cadres of LDC-UDC-Head Clerk’s grade pays are 1900, 2400, 4200 correspondingly. When the MACP upgradation is given, an unprecedented grade of Rs.2800 is granted. This grade pay of Rs.2800 is not at all granted in the structure of ministerial cadre of LDC,UDC,Head Clerks of the department. This anomaly must be solved positively.

In MACP also a point wise clarification is needed as was done in ACP through DOPT OM dated 18.7.2001. We all are eagerly awaiting that.

The efforts made by comrades of our confederation in the recent meeting of MACP anomaly sub-committee on 15/3/11 are exemplary. Salutations to comrades. The sacrifices done so far by our working fraternity will never go waste.

Particularly, regarding agenda items Nos.1,3,8,9 & 29, the official side realized the anomalies explained by our comrades and accepted to consider how to overcome those anomalies.

In many departments the cadres are facing such problems. A grade pay which is not at all in the structure of the department was given as MACP up gradation.

Ministerial staffs were placed in the grade pay that was granted to technical staffs by way of MACP up gradation. Though the ministerial staffs were placed in the technical staffs grade pay, further promotion will not be given for ministerial staffs to a technical post. The fall back status will remain same.

This cannot be treated as career progression at all.

The career up gradations for ministerial staffs must be given in the same avenue and in the same structure to which they belong to in the department.

Then only it can be a meaningful career progression to overcome the fall back status.

In our department, the grade pays, granted for LDC-UDC- Head Clerks structure are 1900, 2400, 4200 respectively. But, under MACP up gradation, from Rs.2400, a grade pay of Rs.2800 is given. This grade pay of Rs.2800 pertains to the structure of technical posts. It is not at all granted in the structure of LDC-UDC-Head Clerk. A staff belongs to LDC UDC structure, cannot get further promotion to a technical post, though he was placed in a technical post grade pay of Rs.2800,

This cannot be treated as career progression.

To resolve this anomaly for LDC-UDC-Head Clerks, MACP up gradations must given in the granted structure of 1900-2400-4200.

In Railways the grade pay of Jr CLerk is Rs 1900, Sr.Clerk is Rs 2800, Hd Clerk/OS II is Rs 4200 and OS I/Ch OS Rs 4600. But inspite of the grade pay hierarchy of Ministrial Staff, MACP was awarded only Rs 100 to Jr.Clerk's as the next Grade pay to Rs 1900 is Rs 2000. Please Think once, as in Ministerial hierarchy you can't find a grade pay of Rs 2000, How this can be treated as career progression.

We are demanding the first 2 ACPs may be continued in the promotional hierarchy to be granted after 12 and 24 years of service from the date of induction, the third ACP on completion of 30 years service may be in the grade pay hierarchy.The anamoly committee is making injustice towards the technical cadre of delhi govt,(Inspectors of motor vehicles ).We were recruited in pay scale 0f 5500 in year 1987 and got first ACP in year 1999 in pay scale of 6500.subsequently after implementation of MACP ,we are given 4800 as grade pay for second 2nd MACP ,whereas as per pre MACP and according to old ACP , we were supposed to get grade pay of 6600.You can very well understand the pathetic situation, where we are not getting normal promotional but also suffer from the implementation of MACP,

Please take necessary positive steps from our MACP anomaly sub-committee.Thnking u

Sir,

How long will it take to finalise the issues related to MACP, Especially for those artisan staff who were placed in HS Grade-I as a result of 50-50. As on 1.1.2006 this should never be treated as promotion and due MACP should be given to those who have completed 10,20 or 30 years respectively.

One more thing that the PART -I Cadre trades like TCM, EE Mech etc are always equal to the HS Grade-I of the Part - II cadre Trades like VM etc.

Please expedite this case at all levels.

Having implemented the VI CPC with retrospective effect the Govt. should have also allowed all the employees who were in service on 1/1/2006 to get the benefits recommended in the
VI CPC.Most of the benefits should not be confined to the still serving employees only.A large number of employees did not get any benefit under the old ACP and they are not eligible to have the MACP scheme benefit also as the recommendation was given effect from 1/9/2008.I request the leaders to take up the case with the Govt. of India so that the eligible retired employees can also have at least some benefit.

Why official side is unable to understand the agony and pain of those who are at a great financial loss. Members of official side if placed in the situation which we are facing then only understand. First the members of the 6th pay commission were foolish who made such recommendation in place of ACP and another greats are our official side members who can rectify that mistake but not willing to do so. They may want bribe, I think, otherwise the problem which can be seen even by the layman cannot be seen by them.
