OFFICE MEMORANDUM

Subject : Policy to be followed in case where persons refuse promotion to a higher grade.

The undersigned is directed to invite the attention of the Ministries/Departments to the provisions contained in this Department's O.M. No.1/3/69-Estt.(D) dt. 22.11.75 on the above subject and to say that this issue was discussed in the meeting of the National Council. It was observed that in many cases persons refuse promotion purely to gain monetary benefit specially in cases where the increment of the officer is due in the lower grade shortly. This it was felt causes considerable hardship to many Govt. employees due to the chain reaction fo postponing of the promotion of officers down the line and awaiting promotion. In order to discourage such refusal of promotion, the Government issued orders laying down that those officers who refuse promotion should not be issued any fresh offer of promotion for a period of six months from the date of such refusal.

2. Govt. have recently taken a decision to further liberalise the formula of fixation of pay, in order to avoid anomalies in the matter of fixation of pay. These orders are being separately issued.

3. In view of the fact that Government have decided to further liberalise the procedure of fixation pay of officers, and also to reduce cases of refusal of promotion to the barest minimum which adversely affects of the promotion prospects of officers working down the line, it has now been decided to modify the provisions contained in this Deptt's O.M. No.1/3/69-Estt.(D) dated 22.11.75 mentioned in para 1 above, to the effect that from the date of issue of this order, refusal of promotion by an officer should entail that no fresh offer of promotion would be issued to him for a period of one year, instead of six months as provided for in the earlier instructions.

4. It is further clarified that in cases where the reasons adduced by the officer for this refusal of promotion are not acceptable to the appointing authority, then he should enforce the promotion on the officer and in case the  officer still refuses to be promoted, then even disciplinary action can be taken against him for refusing to obey his orders.

5. These instructions take effect from the date of issue of this letter.

6. In so far as the officers working in the Indian Audit and Accounts Deptt., these orders are being issued with the concurrence of the Comptroller and Auditor General of India.

7. Ministry of Finance etc. are therefore, requested to bring the above decisions to the notice of all officers working under them for their information and compliance.

Government Launches Drive to fill up Vacant Posts of SCs/STs/OBCs/PWDs

The Government has launched a drive to fulfil the backlog vacancies of Scheduled Castes, Scheduled Tribes and OBCs and Persons with Disabilities.

This is following a review of the vacancy position in these categories by the Union Minister of State for Personnel, Public Grievances & Pension, Shri V.Narayansamy recently. All Ministries/Departments have been directed to fill up all the vacant posts in these categories by March 31, 2012.

The Government has been concerned about non-filling up of large number of backlog vacancies reserved for SCs/STs/OBCs/PWDs. Therefore, two Special Recruitment Drives – one for SCs, STs and OBCs another for PWDs were launched in 2008 and 2009 respectively.

The Drives enabled various offices to fill up about 26750 backlog vacancies but large number of such vacancies are remaining to be filled up.

           This Department in 0M No AB14017/61/2008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules/Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations. Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMs dated 15.12.09 (Non-Technical) and 18.01.2011(Engineering Services). The provisions with regard to grant of functional scale of Rs.14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in 0M dated 29.12.2010 also refers. Instructions for grant of NFU as per 6th CPC recommendations have been issued in 0M dated 24.4.09

2.       As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the Ministries/Departments/Cadre Controlling Authorities of Organized Group ‘A’ Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPT/UPSC & Ministry of Law.

Sub: Enhancement in the rate of various allowances by 25% as a result of enhancement of dearness Allowance w.e.f. 01.01.2011.

       In accordance with the recommendations of 6th CPC, the rates of various allowances admissible to different categories of railway staff were revised/doubled. The 6th had also recommended that the rates of these allowances will be increased by 25% every time the Dearness Allowance goes up by 50%. Railway Board accordingly issued instructions in respect of various allowances listed in the enclosed Annexure alongwith the letter references under which Railways were authorized to implement the same.

   2. Subsequent to enhancement in the rate of Dearness Allowance to 51%, the matter regarding revision in the rate of various allowances has been considered by the Board. In order to dispel any doubts that may arise in the Railways, it is reiterated that the rates of allowances listed in the enclosed Annexure shall increase by 25% with Dearness Allowance now having gone up by 50% w.e.f. 01-01-2011.

   3. The terms and conditions for grant of these allowances will remain the same.

Subject:- Policy to be followed in case where persons refuse promotion to a higher grade.

The undersigned is directed to say that cases occasionally arise when government servants offered promotion to a higher post refuse to accept the promotion, for personal reasons. Such refusal of promotion may in many cases create administrative difficulties and government work may also suffer. The question as to what action should be taken in cases where government servants refuse promotion to a higher grade, has been considered in this department and it has been decided that such cases may be dealt with in the manner indicated in the subsequent paragraphs...

2. When a government servant does not want to accept a promotion which is offered to him, he may make a written request that he may not be promoted and the request may be considered by the appointing authority, taking relevant aspects into consideration. where the reasons adduced by the persons concerned for such refusal ordinarily meet the requirements of the case if the next person in the select list were promoted.  However, since it may not be administratively possible or desirable to offer appointments, to the persons who initially refused promotion, on every occasion on which a vacancy arises during the period of validity of the panel, no fresh offer of appointment on promotion should be made in such cases for a period of six months from the date of refusal of first promotion. Government servants refusing promotion for reasons acceptable to the appointing authority will, on eventual promotion to the higher grade, lose seniority vis-a-vis their erstwhile juniors promoted to the higher grade earlier than they, irrespective of whether the posts in question are filled by selection or otherwise.

3. The above mentioned policy will not apply where adhoc promotions against short-term vacancies are refused.

4. It is requested that Ministry of Finance etc. may bring these instructions to the notice of all persons employed under them including those in attached and subordinate offices. In so far as the persons belonging to the Indian Audit and Accounts Department are concerned, these instructions are being issued in consultation with the Comptroller and Auditor General of India.

    Kind reference is invited to this office letter of even No. dated 12-09-2008 through which the approval of Competent Authority was conveyed for allowing line staff to collect and distribute phone bills of BSNL on the incentive rate of  Rs.2/- (Two) per bill for delivery and Rs.3/- (Three) per bill for collection, on certain terms and conditions as indicated therein.

    The instructions contained in the letter mentioned above are hereby re-iterated for wide circulation in all the SSAs of your Circle, so that the benefit of the scheme is availed off by maximum members of the line staff. 

    Moreover, it has been desired to have monthly reports on achievement made through the scheme from all Circles (SSA wise), for the ensuing three months i.e., July, August and September 2011.            Eligibility of permanently disabled son of a Central Government Health Service (CGHS) beneficiary to avail CGHS facility has been clarified with respect to schizophrenia as a disability. It is clarified that schizophrenia is a case of mental disorder and falls within the definition of disability as defined in Section 2 (i) of The Persons  with  Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (No.1 of 1996) and is covered by the terms `mental retardation' and `mental illness'.

Pension Reform 

One very common policy response to increased longevity is pension reform to ensure the future sustainability of pension systems while ensuring that older people receive adequate retirement income (OECD, 2009). The most common measures taken are raising the state pension age, scrapping or limiting the possibility of early retirement and encouraging personal (individual/employer) pension provision (OECD, 2009; OECD, 2006).

Almost all OECD countries have made changes to state pension age; those with a state pension age below 65 are in the process of raising it such as Japan, Korea and the Czech Republic, whereas countries such as the UK, Germany, Denmark and the Netherlands that already have a state pension age of 65 are increasing it (OECD, 2009; Guardian, 2010). However, it is important to note that most while the state pension age guides retirement, many people retire before reaching it, while others choose to continue working (Berry, 2010).
 
Many countries including Portugal, Turkey, France, Germany, Italy, Japan and Sweden have cut future benefits, although many have targeted cuts so that poorer people are not adversely affected (OECD, 2007). A number of OECD countries, such as France, Hungary, Poland, Portugal and Germany have made personal pension provision more attractive through favourable tax treatment, while other countries such as New Zealand and the UK have introduced or are introducing opt-out personal pension schemes for people without access to employer based schemes (OECD, 2009). 

When it comes to incentivising early or later retirement, there are differences (OECD, 2009). Countries can however take different options; for example Germany retains state funded early retirement which acts as an incentive, whereas the UK abolished it a long time ago and incentivises people to retire later by improving pension entitlements for those who defer their state pension (Muller-Camen et al, 2011). 

While some OECD countries such as the USA do not have a default retirement age, many do. Until recently, the UK had a default retirement age of 65, which meant that an employee could be forced to retire at 65 even if they did not want to (BIS, 2011) The scrapping of the default retirement age was warmly welcomed by older people’s organisations and trade unions and cautiously welcomed by employers; retirement will now become the subject of negotiation between employee and employer (BBC News, 2010a).

India

The vast majority of individuals in India currently have no pension provision. The main exceptions are government employees, although the government is introducing a new voluntary scheme for all Indian citizens.

The eligibility age for pensions for central government employees is 60, recently increased from 58, although it remains 58 for various state governments. There are no gender differences. There are, however, different rules for the superannuation pension, family pension, invalidity pension, and disability pension - the various different pensions available to state employees. Public sector pension schemes generally have retirement ages of 60 years. However, employees can obtain voluntary retirement after 15 years of service (recently reduced from 20 years).

After a decade of discussion and controversy, the Indian government launched in 2009 the National Pension Scheme, which all Indian citizens aged 18 to 55 can join voluntarily. It is a system where individuals fund, during their working life, their financial security for old age. Those who join will receive a Permanent Retirement Account (PRA), which can be accessed online and through so-called points of presence (PoPs). Account holders may benefit from equities investment return - the first scheme of its kind supported by the Indian government.

Crucially, subscribers can retain their PRAs when they change jobs or residence, and even change fund managers and the allocation of investments among different asset classes (although exposure to equity has been capped at 50%). The minimum contribution to a PRA is Rs 500, to be paid at least four times a year. The maximum that can be contributed per year is Rs 6000.

There are complex rules around retirement age and the National Pension Scheme. If a subscriber exits before the age of 60, he or she may keep one-fifth of accumulated savings, and use the remaining funds to purchase an annuity. Subscribers who exit between the ages of 60 and 70 must use at least 40% of the fund to buy an annuity, but take the remaining fund as a lump sum, which can be payable in instalments. Survivors of subscribers receive the entire fund as a lump sum.

(iib) For revalidation /re-issuance , fee of Rs.500 per coupon is levied.

E-Ticket on Mobile Phone now Possible through new Web Portal Facilitating Travel by Merely Displaying SMS Without Ticket Printout
No Travel Agents Allowed to use New Web Portal to Facilitate Convenient Booking by Normal Passengers
 

In a milestone measure undertaken by Ministry of Railways for the benefit of   rail users, a comprehensive Indian Railway Web Portal with the URL www.indianrailways.gov.in has been launched with a view to consolidate all the services and information onto a single window web-interface for the public.   This comprehensive omnibus single window web interface will be for the entire Rail User community of India whether they are Passenger Service, Freight Service or Parcel Service Customers.

At an impressive programme jointly organized by Eastern Railway and Kolkata Metro Railway  yesterday at Kolkata, former Union Railway Minister and presently the Chief Minister of West Bengal, Mamata Banerjee launched this unique public friendly facility.  Minister of State for Railways, Shri Mukul Roy was among those specially present on this occasion.  The other activities inaugurated at this function included Automatic Fare Collection & Passenger Control  System (AFC & PC)  gates at all Kolkata Metro  Stations.
 
Indian Railway Web Portal has following components:

1. Hosting the existing websites of Railway Board, all the Zonal Railways, Production Units onto the portal.
2. Creation of uniform Web address system of all the Railway Websites
3. Tracking facility for freight trains running and Parcels status by customers
4. Journey planner with user-friendly functionalities.
5. E-ticket functionality dedicated for normal passengers. 
6. Facility to book retiring rooms for any station.
7. Mobile phone based ticket booking in which passenger need not print his/her ticket but carry the display ticket sent to his/her mobile phone through SMS.
8. Web and SMS based Complaints and Suggestions Management System for all Railway customers

The e-ticketing module of the Indian Railway Web Portal is expected be the most sought after facility by the normal passenger.  The e-ticketing operations of IRCTC on its website shall also continue in parallel. In the additional facility of e-ticketing provided by IR Web Portal, no travel agents have been allowed so that normal passengers can have ease of booking during peak hours.

The Portal will broadly provide e-ticketing on the Internet (booking and cancellation) and e-ticketing on mobile phone (booking and cancellation).

Individual users choosing to use the e-ticketing facility shall be required to register himself/herself for the first time for this purpose after submitting the mandatory details and shall be provided a unique user ID.  This registration will be free of charge.  Thereafter he can avail the services of Booking and Cancellation of e-tickets.  He can take a printout of the e-ticket which is known as Electronic Reservation Slip (ERS).

Individual users desirous of utilizing the facility of booking e-ticket on mobile phone ( which is being named as m-ticket), having requisite internet facility can do so by downloading the mobile ticketing application on the mobile phone from the IR Portal, using the URL sent in SMS.  On completion of booking and payment formalities, a SMS containing the ticket details will be sent to user which is referred to as Mobile Reservation Message – (MRM).  The cost of MRM from IR Web Portal shall be borne by Indian Railways.  Such passengers need not require to carry a print out of the ticket and instead display the SMS (namely MRM).  Similarly a Screen-shot of the e-ticket displayed through laptops/palmtops (referred as Virtual Reservation Message – VRM) will also be construed as e-ticket and such passenger also need not take a print out of the e-ticket and instead display the Screen-shot on their laptops/palmtops.

  • It is mandatory that at least one passenger booked on the e-ticket/m-ticket carry at least one of the following eight proofs of identity (in original ) :
    Ø Voter Photo Identity Card issued by Election Commission of India.
    Ø  Passport.
    Ø  PAN Card issued by Income Tax Department.
    Ø  Driving License issued by RTO.
    Ø  Photo Identity card issued by Central/State Government.
    Ø  Student Identity Card with photograph issued by recognized school/college for their students.
    Ø  Nationalized Bank Passbook with photograph.
    Ø  Credit Cards issued by Banks with laminated photograph

ERS/MRM/VRM along with any one of the eight prescribed ID proofs in original and the indication of the passenger(s)’ name(s) in the Reservation Chart will entitle the passenger(s) to travel.

ERS/MRM/VRM along with one of the eight prescribed proofs of Identity in original will also authorize the passenger to enter the platform on the day of journey and he/she will not be required to purchase platform ticket.  ERS/MRM along with original ID proof will be required to be produced on demand by Ticket Checking Staff on the platform.

The facility of booking e-tickets through IR Web Portal will be available from 00.30   hours to 23.30 hours daily.  The booking for a particular train shall be permitted up to the time of preparation of reservation charts.

A maximum of eight PNRs per user ID per month shall be permissible.  The passengers can book seats/berths on the e-ticket on the web portal against General quota/Tatkal quota/Ladies quota/Senior Citizen Quota.  No concessions, except Senior Citizen concession, will be allowed on e-tickets.  No Group Booking shall be permissible on e-ticketing through Indian Railway Web Portal.

The service charges levied by the Railways will be Rs. 5/- per ticket for Sleeper Class (SL) and Second Sitting (2S) classes and Rs. 10/- per ticket for all other Reserved Classes.

The detailed procedure of cancellation and refund has also been mentioned in the IR Web Portal.

We feel features, expectations and calculations are on the forefront for most of the central government employees regarding the additional Dearness Allowance from July, 2011 to be announced soon.

There will be no change in the 7% DA unless a huge change takes place in the month of June AICPIN (i.e.if the AICPIN falls below 180 points or increase above 195, a change of DA can take place, but chances are very remote.) AICPIN now stands at 187.

Surprisingly, some employees are eager to know if the DA crosses 100%, it will merge with the basic pay or not.

Post Office Savings Accounts to be taxed from current fiscal

The government has decided to levy tax on the interest obtained on Post Office savings schemes from the current financial year.

The Central Board of Direct Taxes ( CBDT )) has brought out a notification in this regard recently, which stipulates that any interest earned beyond Rs 3,500 (in case of individual accounts) and Rs 7,000 (in case of joint accounts) will be taxable from the running fiscal.

The CBDT-- which is the administrative authority of the Income Tax Department-- has issued the notification to all the tax collection ranges across the country for implementation.

            The second Central Pay Commission report submitted in 1959, in its report the commission has strongly recommended that the Central Government should encourage the growth of Education Schools with a common syllabus and medium of instruction for the benefit of the children of Central Government employees liable to frequent transfers as well as other floating population in the country.

Finally the Union Cabinet approved the Central Schools Scheme on the 20th November, 1962.

The central schools scheme had envisaged that the management and property of the Central Schools should be transferred to an Autonomous Body, which would receive grants from the Government of India. In pursuance of this and also the recommendations of the Inter-departmental Committee, the Central School Organization (since renamed as Kendriya Vidyalaya Sangathan) was registered as an Autonomous Body under the Societies Registration Act, 1860, on the 5.12.1965.

The scheme for establishment of Central Schools was approved by the Government of India in 1962 and its implementation was started by the Ministry of Education in 1963 when 20 regimental schools run by the Ministry of Defence were taken over and converted into Central Schools or Kendriya Vidyalayas. Later on the Kendriya Vidyalaya Sangathan an autonomous body was set up by the Ministry of Education.

During the academic year 2000-01, there are 854 Kendriya Vidyalayas with a student population of approximately 7.5 lakh. There are two Vidyalayas abroad, one each in Kathmandu and Moscow.

Railway Board’s letter No. 2011/E(LR)II/UT 1-5 dated 13-06-2011 to GS/NFIR.

(I) Background

At the outset NFIR pointed out that in the Joint Committee Meeting held in 4th November, 2008, that 30% and 55% pay element should be continued undisturbed. While retaining the pay element the Board had however doubled the kilometerage rates existed then. Subsequently, T.A. rates got revised by over 3 times, causing serious anomaly in kilometerage rates.

(II) In the special Meeting held today (i.e.. 24th June. 2011) at Rail Bhawan. New Delhi. the aberrations and depression in respect of Kilometerage rates. date of effect were explained by NFIR and placed a proposal as given below in brief for consideration of Railway Board.

(a) Since the pay component is inbuilt in RAC 1980 Formula for calculation of Kilometerage allowances, the rates as on 01-01-2006 should have been revised duly multiplying the mean scale of Passenger Driver / Guard with the VIth CPC fixation factor of 2.118 and correspondingly rates should have been fixed with the then existing T.A. rates and National Average kilometer for all categories of Running Staff.

(b) As on 01-09-2008. the revised KMA rates as per (a) above should have been doubled.

(c) The revised rates as per (b) above are due for upward revision by 25% w.e.f. 01-01-2011, as D.A. had crossed 50%.

(III) NFIR has summed up, urging revision w.e.1 01-01-2006 and thereafter making the rates doubled as on 01-09-2008 and be increased by 25% as on 01-01-2011 as explained vide II (a)(b) and (c) above

NEW DELHI: Now, you can file an RTI with the Municipal Corporation of Delhi (MCD) sitting at home. What's more, you could also track its progress online.

Last week, the civic agency activated the RTI link on its website, making the RTI filing process less cumbersome. It also provided for online payment through credit card. Ever since, 60 applications have been received.

"One has to only select the department, give his/her details like email-id or telephone number and type the questions. The application will be sent directly to the concerned PIO. And since all our departments are now online, the replies could be processed in less time," said Deep Mathur, director, press and information, MCD.

Every RTI applicant will be given a unique ID and password through which he/she can track the RTI. The reply will be emailed to the applicant.

New Delhi: In a major exercise to boost its profitability, the Department of Posts (DoP) plans to introduce core banking solution besides setting up India Post ATMs and debit cards for its customers.
    
"We have set target of bringing in core banking solution by 2012. It will ensure smooth online transactions. We are giving some e-payment services, but they are fragmented," a top offical from Department of Post said.
    
He added that the work for setting up 1,000 India Post ATMs was in advanced stage and DoP had already held parleys with vendors on this front. "We will also issue debit cards to our existing savings account-holders," the source added.
    
The DoP is tying up with banks so that customers can use their India Post debit card at any ATM machine pan-India.
    
With a network reach of over 1.44 lakh post offices, DoP hopes to transform itself into a post bank.     "Yes, this is very much possible. We are offering three-fourth of a bank's services and have the widest reach. The infrastructure is almost ready. In fact, we have given this proposal to the Ministry of Finance and are waiting for its comments," he added.
    
The lack of modern banking facilities in rural areas and dependence of villagers on informal sector for their credit requirements prompted government to establish a post bank.

DoPT to train over 100 officials on handling RTI pleas

NEW DELHI: In order to deal better with growing intra-departmental RTI queries, Department of Personnel and Training (DoPT) has decided to train its over 100 officials on different matters related to Right to Information Act.

DoPT, which acts as a nodal agency to oversee implementation of the transparency law, has decided to train a total of 104 Central Public Information Officers and Appellate Authorities.

The decision was taken after some of its CPIOs complained of difficulties in dealing with RTI applications. Officials said that some of its information officers were reprimanded by Central Information Commission for improperly disposing of certain pleas.

"We have called special trainers for a day-long workshop on July 6. They will answer all the queries related to RTI," a DoPT official said.

He said that 52 CPIOs and their appellate authorities have been chosen for the training and they have been asked to send their queries in advance to save time and ensure proper resolution.

According to official data, about 370 complaints related to Ministry of Personnel , Public Grievances and Pensions are pending with the CIC.

DoPT is also planning to conduct such training for CPIOs of other central government departments too.

Subject: Backlog Training Programme for adhoc Section Officers at ISTM for the period 11-07-2011 to 22-07-2011.

The undersigned is directed to inform that adhoc Section Officers, whose names are given in Annexure I, have been nominated for the above mentioned Backlog Training Programme. This training is being conducted by ISTM w.e.f. 11-07-2011 to 22-07-2011. It is requested that these officials may be relieved of their duties, subject to vigilance clearance and advised to report to Shri Chandan Mukherjee, Deputy Director(Co-ordinator) ISTM, Administrative Block, JNU Campus (Old), New Delhi-110067 at 9 A.M. on 11th July, 2011.

2. The performance of the officials in the training will be evaluated and the reports thereof be added in their APARs. No request for withdrawal of nomination either from the Ministry/Department or the officer concerned shall be entertained by this Department or the Institute. As the instant training is meant for officers who have not undergone the Level ‘B’ training and those who are not above the age of 58 years as on July 2011, the Cadre Units are requested to ensure that the officials nominated to the above programme are relieved in time.

3. As the aforesaid training includes study tour, officers nominated above may be advised to draw necessary TA/DA advance of Rs. 12,000/- each from their respective Ministry/Department. This amount may be released in Cash only.

4. Confirmation with regard to the participation of the officials along with their respective bio-data (Annexure-II) may please be sent by immediately to Shri Chandan Mukherjee, Deputy Director (Co-ordinator), ISTM, New Delhi, with a copy to the undersigned.
