Meeting of the Joint Committee on MACPs Anomalies
As decided in the National Anomaly Committee Meeting held on 17/07/2012, the DOPT held separate meeting with the Leaders of Staff Side at North Block, New Delhi, Room No. 190 on 27/07/2012. Shri.M.Raghavaiah, General Secretary, NFIR has participated in the meeting.
Discussions were held on following issues:-
1. Grant of MACP in the promotional hierarchy :-
The staff side insisted that option be given to individual employees in this regard to facilitate him/her to opt for availing benefit of financial upgradation.
After discussion it was agreed to examine in depth for finding solution.
2. Date of effect of MACP Scheme :
The desirability of giving effect to the MACP Scheme w.e. f. 01.01.2006 will be examined.
3. Counting of total temporary status Casual Labour Service reckoning 10/20/30 years under MACP Scheme:
Official Side stated that this will be processed separately.
4. Treatment of employees selected under LDCE/GDCE Scheme:
In the light of the instructions issued when the ACP Scheme was introduced. The same policy be adopted and accordingly orders will be issued. In other words, those inducted through LDCE/GDCE Scheme, such induction may be counted as appointment and will be reckoned as promotion.
5. Problems faced in the identical Grade Pay:
It was agreed to issue instructions for granting additional increment for fixation of Pay in case of promotion to the same Grade Pay. Instructions in this regard will be issued to Ministry of Railways etc .
6. Financial Upgradation Under MACPs, in the case of staff who joined another unit/organisation on request:
The Staff Side has pointed out that OM dated 01/11/2010 should be suitably Amended covering the staff who were transferred on request on reversion to the Unit/Organisation so that the total service rendered in the previous Unit/Organisation may be counted for MACPs. It was agreed to be considered.
7. Extension of benefit of MACPS to an employee appointed in Grade where direct recruitment element is there while ignoring service and promotion rendered prior to his appointment in that post:
Official Side reiterated that suitable clarification No. 5 of OM dated 09/09/2012 was already issued.
8. Stepping up of Pay of Senior incumbents at par with Junior incumbents as a consequence of ACP/MACPs :
Staff Side has explained the case of gross injustice done, more particularly in the Accounts Department of India” Railways wherein the incumbents who cleared the Appendix examination are drawing less pay than those who could not qualify the said examination and got the benefit of MACPs. The staff side insisted that this situation is leading to de-motivation among qualified staff and urged for rectifying the anomalies. It was agreed to consider and Ministry of Railways advised to send the proposal
9. Employees who got one promotion prior to 01/09/2008 and completed over two decades of service without benefit of promotion and are denied third ACP under MACPs:
After discussion, official side agreed that is a peculiar situation and assured to take action to rectify the situation. The staff side has insisted that in such cases third ACP should be straight away given to staff from the date subsequent to the date of completion of two decades of service after promotion. Official side appreciated the logic and reasonableness and agreed to considered.

10. Modification of recruitment rules particularly in Railways and upgradation granted by abolition of Pay Scale-Implementation of MACPs :
The Staff Side explained that in the Railways the lower Pay Scales were abolished and posts were upgraded to the higher Pay Scales with revision of recruitment qualification and designation. In such cases the staff side insisted that entry Grade Pay as a result of upgradation subsequent to abolition of lower Pay Scales should be taken into consideration for reckoning 10/20/30 years of service for granting MACP.
Official side has agreed to obtain detials from Ministry of Railways for issuing appropriate clarification. In the meanwhile, Railway Board will have discussion with the Staff Side separately so that appropritate proposal could be sent to the DoP&T.
11. Placement of staff as a result of upgradation of posts :
The Staff side (NFIR) insisted that such placements should not be considered as promotion for the purpose of grant of financial upgradation under MACP Scheme.
Official side stated that this will be examined.
12. In the course of discussion the Official Side also stated that MACP Scheme should be a fall-back option and the Ministries should conduct Cadre Restructuring for ensuring that the staff could be promoted within the reasonable time i.e. within 10 years. When the Staff Side pointed out that the Ministry of Railways is citing the instructions of Ministry of Finance issued some years back that only one third of the Cadre could be disturbed, for revising the percentages, the Official Side clarified that necessary clarificatory instructions will be issued to the Ministry of Railways etc., so that the Cadre Restructuring can be done without problems.

If we compare with the employees of direct recruits in the grade pay of Rs.5400 they get jump to Rs.6600, Rs.7600 and Rs.8700 in 1st, 2nd and 3rd ACP.
do something for this?
1.How much time is required for the Official side in NAC to decide the issue? (next 6 months or one year or 2 years)
2.When will be the next National anomoly committee meeting held?
One more discussion is over and not a single word regarding the upgradation of grade pay of UDCs. Federation requires UDCs for strike purpose only ?????

Respected Sir,
I would like to bring following few lines to your kind notice for sympathetic consideration :
1.I was appointed as Watchman in the scale of pay of Rs.196-232 on 23.6.1983.
2.Subsequently, through Departmental examination I was promoted to the post of LDC w.e.f. 08.02.1991 in the scale of pay of Rs.950-1500.
3.Further, I was promoted to the post of UDC w.e.f. 01.12.1995 through Departmental examination in the scale pay of Rs.1200-2040 which was revised to Rs.4000-100-6000 on implementation of 5th CPC recommendations. On implementation of 6th CPC recommendations my pay was fixed in the Pay Band (PB-1) Rs.5200-20,200 with Grade Pay Rs.2400/- w.e.f. 01.01.2006.
4.After implementation of 6th CPC recommendations in terms of DoPT OM No.35034/3/2008-Estt(D) dated 19.5.2009 I have been awarded with Last financial upgradation under MACPS w.e.f. 01.9.2008 in the Grade Pay Rs.2800.
5.In this connection, I would like to bring to your kind notice that UDCs who have been awarded financial upgradation under ACPS on implementation of 6th CPC recommendations their pay have been fixed in the Pay Band (PB-2) Rs.9300-34,800 with Grade Pay of Rs.4200/- w.e.f. 01.01.2006 whereas for those UDCs who have been upgraded under MACPS, they have been placed in the Grade Pay of rs.2800/-.
6. As the UDCs who have awarded financial upgradation under ACPS and MACPS are shouldering the same responsibilities, it is felt that the UDCs who have awarded financial upgradetion under MACPS they should also been given Grade Pay Rs. 4200/- at with UDCs who have been granted financial upgradation under ACPS.
7. It is a big point to be noted that the UDCs who served for 12 years have got Pay band of Rs. 4200/- under ACP after the implementation of 6th CPC recommendations w.e.f 01.01.2006 upto 31.08.2008, whereas I have completed more than 12 years 9 months. of service at the same post (UDC) and unfortunately I have got the Pay band of Rs 2800/-.I don’t understand the logic and the so-called calculation which is haunting me all the time .
8.I, therefore earnestly pray to you to kindly consider my appeal sympathetically and take up the matter suitably with the competent authority so that UDCs like me are granted Grade Pay Rs.4200/- on award of financial upgradation under MACPS instead of Rs.2800/-.
Thanks a lot for your sincere attempts to get justice for ministerial staff. One LDC (whether it is CSS cadre or other Central Govt.Dept)gets his birth from Staff Selection Commission. That means all LDC/UDC are staying in one family. Then defenitely their parents will be DOPT and SSC. If it is correct, why they treat the LDC/UDC etc. of CSS/CSSS and other Central Govt. Department in two ways? Let us also get the same consideration. They granted grade pay of Rs.2800/- for LDC and Rs.4200/- for UDC of CSS. When we all are coming from the same examination, why the partiality to one cadre alone?
i was retired from service on 31.8.2007. But those who retired after sept 2008 got macp benefit got
higher pay and pension benifit. if the macp implemented on the date of6th cpc implemented I would have
the benefit of one promotional pay

The case of JEs of CPWD is also worthy to mention here. When the ACP scheme was introduced, majority of the JEs of CPWD were to face financial loss from 5th year to 23rd years (i.e. the loss was due to the majority JEs were already placed in the time bound scale of Rs 5500- Rs 9000 scale were to be brought down to Rs 5000 to Rs 8000 scale to allow the introduction of ACP scheme). This was to pave way for the 2nd ACP scale of Rs 10,000-Rs 15,200 in the new scheme which was definitely beneficial for the stagnated people completing 24 years. The same lot of JEs/AEs (including the majority of JEs who had to face loss in the ACP introduction), those completing 24 years after 1-9-2008 are now after getting stagnated are going to face a projected financial loss of of Rs 25.00 loss on introduction of MACP scheme in an average span of remaining 14 ½ years compared to the people already got 2nd ACP prior to 1-09-2008.
Even though it is the accepted position of the Govt through the DOPT, the anomalous situation getting created in JEs cadre vide Item No.8 in the meetings of Joint Committee to examine the Anomalies pertaining to the Modified Assured Career Progression Scheme and agreed to address the cases where MACP is less advantageous than the ACP Scheme, the further delay in taking a decision at least to restore the seized existing privilege is definitely a denial of justice only. The Govt is also trying to create bad blood within the cadre between those who already got 2nd ACP prior to 1-9-2008 and due for the 3rd MACP scale with GP 7600 & the people denied with the 2nd ACP due to non-completion of 24years as on 31-08-2008
Moreover, the recently approved cadre review in CPWD (which is coming after 16 years after the last one) implementation, the stagnation level in JE cadre will not come down from the present 27+ years to below 24 years.
We still hope, with the efforts of dedicated and honest leaders like Com SK Vyas, Com Com KKN Kutty ,C Sreekumar etc and through the united struggle of the Central Govt Employees , the justice will prevail. - Babu OV
Steno in CSSS get NFSG after completing 4/5 years service. The same criteria should be followed in other departments immediately. Because STENO/PA line is very risky and having so much tension and are attached to Senior Officers.
anomalies especially in the cadre of LDCs/UDCS. Due to MACP Stagnated UDCS who had completed 24 years after 1-9-2008 reduced their salary already drawn. Due to implementation of MACP a senior most stagnated UDC after 24 years may get only 2800/- grade pay -But in many departments LDC post upgraded and given 2400/- grade pay. They may get 2800/- grade pay after 10 years and 4200/- and 4600/- after 20-30 years. Hence interest of senior UDCs may be protected. At least protect the 2nACP and Salary already drawn after 01-9-2008- or give 4200/- grade pay to all senior UDCS who have completed 20 years of service as on 01-01-2006.
I am also a victim of MACP anomaly. My grade pay of Rs4200/- granted under ACP Scheme after 0-9-2008 reduced to Rs.2800/- and salary reduced. In case ACP was continuing I may get a grade pay Rs.4200/- from 01-11-2008 onwards. Hence DOPT may allow such senior employees to OPT 2nd ACP OR MACP WHICH EVER IS BENEFICIAL AND ACP DUE BETWEEN 01-9-2008 TO 31-08-2010. Hence loss suffering by senior UDCs having stagnation may be avoided. please resolve the issue of stagnated employees.

It still required time to study in depth by the official side. The aim of the government should be to give benefit employees. Now all three MACP should be of promotional hierarchy grade pay. After 3 rd. MACP, if anyone completes of 10 years stagnate in single grade pay they are entitled for one more grade pay.
Where post are isolated and required higher qualifications for that post, employees have not received a single promotion in their career. Please look into the matter for fast track discussion as employees are eagerly waiting.
If employee unions are sincere in giving promotional hierarchy under MACP to lower rung employees Ie;Group-D,LDC/UDC and those stagnated in the Grade pay of Rs-4600 /4800 ,then they should resort to nation wide strike ,if the Govt. don't accede to the demand quickly.It is already too late.
MACP orders were issued on 19.5.2009 giving retrospective effect from 1.9.2008. Had the orders been given effect from the date of issue i.e. from 19.5.2009, those who had completed 24 years of service between 1.9.2008 and 19.5.2009 would also had been benefited, by taking official hierarchy into account i.e.2nd Financial Up gradation under old ACP Scheme would would be given, and their new pay will be fixed in the corresponding pay scale with Grade pay of Rs.4200/- under new MACP Scheme. Therefore Staff side and Official side may please be consider this anomaly issue sympathetically and issue orders giving effect from the date of issue of MACP i.e. from 19.5.2009 so that those who fall between 1.9.2008 and 19.5.2009 will also be benefited.

In this connection, it is very simple that MACP scheme should be replaced by ACP Scheme by giving three financial upgradation in 10,20 and 30 years in the "PROMOTIONAL HIERAARCHY".
Even after 50 years of independence, the vestiges of British rule cannot be erased from the civilian bureaucracy. It is with great anguish we pour our feelings out, and hope that the highest level of the political leadership considers it sympathetically and avoid any inaction by vested bureacratic interests.
The non-class 1 i.e the Group B,C are an aggrieved lot.
The classification of the services under Gazetted-non-Gazetted , Group A, B and C has created a virtual Aparthied like situation wherein we come across cases of Group A officers having a disdainful and supercilious attitude towards their non UPSC, Non Class 1 subordinates bordering on hubris.This over time crates an ivory tower mentality.What is so sacrosanct about this classification that it is leads to vested interests protecting their turfs and how can you have social justice in society when the civil service itself has such an inegalitarian hierarchal structure that it it in danger of falling apart if any other formation based on social justice platform like Mayawati comes to power at the centre. Before we go public on this issue, I suggest that the Govt.
act on it and take some remedial measure before any social upheavel shakes up the very citadels of our bureaucracy.
This has assumed such an Institutionalized setup that it almost mirrors the varna system in Hinduism.
Everything is based strictly on hierarchy and not on value.The hiatus is too wide to bridge, given the sacrosanct nature of Group A.
How sacrosanct the Class 1 scales in the sixth Pay Commission are, can be gauged by the substantial jump in some allowances and perks in the Grade Pay of Rs 5400/ and PB-3 and the virtual red letter highlights in PB-3
as 'Group A induction'.
Lack of any lateral upward moves on the part of the lesser
mortals to move up the Varna system, which euphemistically is
referred to as Induction in group A, and which is tantamount to a lower varna person being baptised into a higher one, has created a deep resentment in many talented employees who by virtue of bad luck could not make through UPSC and had to opt for SSC instead.This system,like the caste system, is designed in such a way that it precludes any latent talent in the lower rungs.
Probably no other Instituition has this kind of divergence
wherein a certain class of people are condemneded to stagnation for the rest of their lives ,however talented they may be.
As a first step towards alleviating this historical wrongs,
the Govt can make towards abolishing this classification into A,B,C,D and gazetted.Also any graduate in Govt. service in whatever grade pay should be made to appear for an exam and given an opportunity to get the Grade pay of Rs 5400/ after he clears certains minimum criteria in a transparent manner.
It is never too late in History to correct a wrong.
Some of the privileges enjoyed by the higher echelons like
unquestioned study leave, can also be extended to all sections
as everyone can justify value addition after taking a
sabbatical off for education. I dont see any reasons why
a non -gazetted employee who has put in 20 years service
should be denied permission for a 2 year study leave, on loss of pay. Why cant you frame rules on this.
Secondly as the recommendations of the Chairman of the Commission do carry some weight, I suggest that keeping the egalitarian nature of our Constitution in mind kindly keep the ratio of the Highest vs the lowest pay at the ratio of the fourth pay Commission.
Thirdly , there should be scope for lateral or upwardly induction of exceptionally talented staff from non group A ,who by virtue of mischance might not have fared well in the UPSC civil services examination and who are condemned to stagnation for the rest of their lives.This will address to
a great extent the frustration and resentment in them.

Subject:- Introduction of new Assured Career Progression Scheme on completion of 4. 9 & 14 years of service in a cadre and restoration of old (8-16-24-32) Assured Career Progression Scheme for government employees.
Sir/Madam
I am directed to invite a reference to the subject cited above and to state that the matter regarding grant of Assured Career Progression Scheme on completion of 4, 9 and 14 years of service in a cadre has been engaging the attention of the State Government for some time past. The Governor, Himachal Pradesh, is pleased to introduce Assured Career Progression Schemes on completion of 4, 9 and 14 years of service in a cadre w.e.f 27.08.2009 (i.e. date before which earlier scheme was in operation) which shall apply to all categories of State Government employees governed by Himachal Pradesh Civil Services (Revised Pay) Rules, 2009. except in respect of the following cases/categories:-
(i) Such categories of government employees who have been allowed three or more grade structure of pay scales under the H.P. Civil Services (Revised Pay) Rules. 1998 and further corresponding conversion under H.P. Civil Services (Revised Pay) Rules, 2009.
(ii) Those categories of government employees for whom benefit of Career Progression is/was available under any other rules/instructions notified earlier.
(iii) Those categories of government employees, whose pay scales are governed by MHRD/UGC guidelines. All India Service Officers, Judicial Service Officers etc, having different pay structures.
2. This scheme is optional. An existing employee “including employee having less than four years service” will have the option, either to continue in the existing Assured Career Progression Scheme after a service of 8, 16, 24 & 32 years or to opt 4, 9 & 14 years Assured Career Progression Scheme. An employee who wants to opt this new scheme will have to exercise an option within two months from the date of issue of this letter along with an undertaking in the enclosed proforma through a sworn affidavit that he wants to accept this scheme effective from 27.08.2009 and will not claim any arrears. Consequently, on restoration of earlier Assured Career Progression Scheme (8-16-24-32), in new pay structure w.e.f. 27.08.2009 an employee may also exercise his option for the aforesaid scheme. However, an employee who does not exercise any option within the above stipulated period of two months shall be deemed to have opted for continuance in the earlier (8-16-24-32) Assured Career Progression Scheme with effect from 27.08.2009. Service in a cadre rendered by an employee in the same post before 27.08.2009 shall Count for the purpose of grant of benefit under this scheme.
Hope, DOPT brings out order for option to the individual employees to choose either ACP Scheme or MACP Scheme.
Otherwise, what is chance of winning petition filed for granting ACP instead of MACP against GOI in CAT citing given reasons.
1. After ten years of service, asked to accept MACP instead of ACP. Its cheating by GOI now.
2. No all india or local posting liability. So, no department with vacancies for promotion.
3. Never given choice to sit for any DPC, even though i holds bachelors degree qualification. Nowhere to prove myself.
4. Cadre declared dying. Higher
headquarters in many way disown us.
Please share inputs if anybody have filed petition for ACP.

But his juniors who joined as clerk and later promoted AS SO/AAO after passing SOGE exam has been granted MACP with higher grade pay of rs. 5400/- leaving the senior staff on the GP of 4800/- . due to implementation of such scheme, the seniors have been victimized in the higher financial up gradation.the higher financial up gradation should not be based on the limit of promotion in his service.in this case whether senior employee is entitle to the higher grade pay under MACP, this may please be clarified.
I would like to draw the kind attention of all the members (both staff & official) regarding BLUNDER ANOMALIES discussed in earlier meeting point No 8 in which GP of hierarchy in MACP given which create jealous & hatred among staff of same post with difference of joining period of two/ three months or even a single day ( before or after 31-8-84) particularly the JE`s of CPWD,DDA,MCD,DUSIB& other Govt Deptt. generally they did not got promotions even after 25 years of successful service. Those JE`s join BEFORE 31-8-84 will get the GP of 6600 in II ACP& 7600 in III MACP and Those JE`s join AFTER 31-8-84 will get the GP of 4800 in II M ACP& 5400 in III MACP. The difference of salary will be more than Rs 6000 at present which may increases up to Rs35000 and total difference will be Rs 39,00,000/-though they performs the same duties which is against the Govt own policy SAME POST SAME WORK SAME SALARY.ACP>MACP
It is requested & suggested that in MACP Of 10-20-30 should be amended to 12-24-30 with same PB&GP as promotional for 12-24 and for 3rd MACP. after 30 years may be next GP of hierarchy for all, does not violate the rule same post same work same salary as against 10-20-30. It is prayed/appealed/ humble requested to look into genuine anomaly and do the justice. And same should be added in the agenda for next NAC meeting .
