Criteria for Issue of Passport under Tatkaal Scheme 

The Government had introduced the Tatkaal scheme to issue passport to citizens in an expedited manner (after liberalizing the requirement of documents and within the basic parameters of security consideration). The Scheme was launched on 1 January 2000 to provide a transparent and systematic avenue to applicants for issue of passports in a time bound manner, subject to production of proof of urgency. Under the scheme, passport applications are processed on post-police verification basis (where required). The Scheme was further expanded and liberalized with effect from 23 December 2006. Now, no proof of urgency is required for out of turn fresh/re-issue of passport under Tatkaal Scheme. Similarly, no Tatkaal documentation is required for minor passport, if application falls in no Police Verification category. There was also expansion of the list of the officials authorized to issue Verification Certificate. Also the applicant has been given an option to submit the Tatkaal applications on the basis of three documents out of 16 documents (one of the three documents has to be a photo identity document).

There were 8896 AYUSH drug manufacturing units (licensed pharmacies) in the country as on 1.4.2011. Out of these, 99.6% licensed pharmacies were controlled by non-government bodies and only 0.4% pharmacies were in Government sector. System-wise distribution of these units were quite uneven as 86.5% licensed pharmacies belonged to Ayurveda, whereas 4.9%, 3.9% and 4.7% were under Unani, Siddha and Homoeopathy systems respectively.

Information about appointments secured on the basis of fake/false caste certificates is not centrally maintained. 

However, the Central Government had taken one time exercise to collect information about appointments secured on the basis of fake/false caste certificates in the year 2010. As per information received from various Ministries/Departments etc., 1832 appointments were allegedly secured on the basis of fake/false caste certificates. Disciplinary proceedings had been instituted in all the cases. It was reported that out of the above 1832 cases, 276 had been resulted in suspension/removal etc., whereas 521 cases were entangled into litigations and in remaining 1035 cases disciplinary proceedings were pending.

EXPLANATORY NOTE ON DEMANDS

Item No. 1. Revision of wage with effect from. 1.,01..2011.
The present wage structure of the Central Govt. Employees has been made on the basis of the 6th Central Pay Commission’s recommendations.  The 6th CPC introduced a new concept in the form of Pay band and Grade Pay.  The recommendations of the Commission were implemented with effect from 1.1.2006 in the case of Pay and in the case of allowances with effect from 1.9. 2008.  In the case of Central Public Sector undertakings, the wage revisions normally takes place after every five years.  The 5th CPC in the case of Central Government employees recommended wage revision in every 10 years.  In the past wage revision has been linked to the extent of erosion of real wages.  The degree of inflation in the economy determines the pace of erosion of the real value of wages.  The retail prices of those commodities which go into the making of minimum wages have risen by about 160% from 1.1.2006 to 1.1. 2011, whereas the D.A. compensation in the case of Central Government employees on that date had been just 51%.  It is also an acknowledged fact that the 6th CPC had computed the minimum wage by suppressing the retail price of these commodities in the market on the specious plea that official statistics of the retail prices of these commodities were not available.  They therefore, computed the retail price by increasing the wholesale price by 20% for each of the commodity whereas the actual retail price in the market was 60% more than the wholesale price.  While in the case of Group B,C & D employees, the Commission applied a multiplication factor of 1.86 for arriving at the revised pay structure, in the case of Group A Officers, the factor was ranging from 2.36 to 3 times. In the matter of fitment formula also, unlike recommended by the 5th CPC, the 6th CPC adopted varying percentages whereby the officers in Group A were given rise extending from 42 to 49%, whereas the employees in Group B,C,D were granted only 40%. While implementing the Commission’s recommendations, the Government further accentuated the discrimination further. The recommendations of the 6th CPC when implemented gave rise to very many glaring anomalies. They were assured to be looked into and settled through negotiations in the JCM. The effectiveness of JCM as a potent forum to settle issues has been eroded over the years. Thus, though the National Anomaly Committee met 4-5 times, it could not settle any major issues.

The price index which is called as AICPI – IW (All India Consumer price Index for industrial workers with the base as 2001=100) for the month of September 2012 has been issued by Government.

As we are in the halfway mark of calculating D.A. effective from 01.01.2013, let us try to predict it based on current trend. The AICPI-IW No. for three months , i.e. July, Aug, Sep 2012 is punlished by the labour bureau. It is respectively 212,214 and 215. Based on current situation, if we assume that inflation will remain same and the next three months figure remains static at 215, the total D.A. will be 80% of pay as on 01.01.2013.

Expectation-1
If we expect only 1 point increase in this index for every month the Dearness Allowance for Central Government Employee will touch 80% in January, 2013.  In view of increased LPG & Diesel price etc. we expect more monthly increase in Index and similarly in future DA.  Please go through the following calculation:-

The undersigned is directed to state that Annexure III has been used to obtain in formation from Banks for revision of PPOs of pre-2006 pensioners/family pensioners. It is seen that getting information from Banks is fraught with difficulties. Secondly, the Annexure III sent by the banks are in many cases incomplete to the extent that the calculation details are not available for evaluation by the PAOs and as such the Annexure is being used largely to confirm the existence of the pensioner/family pensioner and to link him/her with the current paying branch.

Dear Sir,

Sub: Revival of the JCM functioning- Departmental level-Regarding :

We solicit your kind reference to the discussions at the National Anomaly Committee meeting held on 17th July, 2012 when the leader and Secretary Staff Side  and other members of the Staff Side brought to your kind notice that the JCM at the Departmental Council level in most of the Ministries other than Railways and Defence have become defunct.  The Staff Side also informed you that the recognition of Service Association, despite the submission of the requisite applications and adherence to conditions stipulated under the CCS(RSA) Rules, 1003 are denied by the heads of departments for no legitimate reasons.  The attitude of the Official Side in this regard has resulted in the virtual shutting out any discussion on issues of concern to employees in various Ministries.     You had been good enough to assure us that concrete steps would be taken to revive the functioning of JCM at all levels and in all Ministries.

Confederation News : One day strike on 12th December, 2012 - charter of demands

The Confederation of Central Government employees and workers in its last National Council meeting decided to call upon its members to organise a day's strike on 12th December, 2012 in  pursuance of a 15 point charter of demands, which include inter alia setting  up of the 7th CPC for wage revision, withdrawal of PFRDA Bill and extension of the defined benefit pension scheme to all Central Government employees  irrespective of date of their entry into Government service, removal of conditions imposed on compassionate appointments', stopping outsourcing  contractorisation, five promotions in the service career as is provided to the organised group A services , merger of DA with pay, acceptance and implementation of arbitration awards, revival of the JCM functioning etc. .
Etc.

The Secretary General K.K.N.Kutty have also written to the Secretary Generals of AIDEF, INDWF, AIRF, NFIR and FNPO seeking their support.

We have enclosed herewith the charter of demands.

CHARTER OF DEMANDS

1. Revise the wages of the Central Government employees with effect from 1.1.2011 and every five years thereafter by setting up the 7th CPC.

2. Merge DA with pay for all purposes with effect from. 1.1.2011.

3. Remove 5% restriction imposed on compassionate appointments and the discrimination on such appointments between the Railway workers and other Central Govt. employees.

4. (a)  Revive the functioning of the JCM.  Convene the meeting of the Departmental Councils in all Ministries/Departments.  Settle the anomalies raised in the National Anomaly Committee as also in the Departmental Anomaly Committees. Hold National Council meetings as specified in the JCM constitution. (b) Remove the anomalies in the MACP Scheme.(c) Grant recognition to all Associations/Federations, which have complied with the formalities and conditions stipulated in the CCS(RSA) Rules.

5. Fill up all vacant posts and creates posts n functional requirements.

6. Stop downsizing outsourcing, contractorization, corporatization and privatisation of Governmental functions.

7. Stop price rise; strengthen the PDS.

8. (a) Regularise the daily rated, contingent, casual workers and introduce a permanent scheme for periodical regularisation; (b) Promote all eligible Grameen Dak Sewaks of Postal Department against 50% Postmen Vacancies and 100% MTS vacancies without resorting to direct recruitment. (c) Raise the Bonus ceiling of GDS employees on par with other workers in the country.

9. (a) Stop the proposal to introduce the productivity linked wage system; (b) discard the performance related pay structure;(c)  introduce PLB in all Departments; (d) remove the ceiling on emoluments for bonus computation.

10. Revise the OTA, Night duty allowance and clothing rates.

11. Implement all arbitration awards;

12. Make the right to strike a legal and fundamental right of the Government employees on par with the other section of the working class.

13. Grant 5 functional promotion to all employees as is provided for in the case of Group A services.]

14. (a) Withdraw the PFRDA Bill. (b) Rescind the decision to allow FDI in pension sector;(c) Scrap the new contributory pension scheme (d) Extend the existing statutory defined pension scheme to all Central Govt. employees irrespective of their date of entry in Government service.

15. Vacate all Trade Union victimisation, and more specifically in the Indian Audit and Accounts Department.

It was agreed in the last National Anomaly Committee meeting held on 17th July, 2012( as could be seen from the minutes issued in this regard) that in cases where promotion to a post carrying the same grade pay, benefit of one increment would be considered subject to the condition that the promotional post carries higher duties and responsibilities under FR 22 and fixation benefit under FR 22 (1)(a)(i) was available prior to the implementation of the 6th CPC report and the merger of the two grades was not on functional considerations.  However, in implementation of this agreement, no formal orders were issued so far.

I am directed to refer to your letter No.22/2012 (DC) dated 18.09.2012 on the above subject and to state that Tech-I are being allowed to be included in the zone of Consideration for the post of Junior Engineer by examining Railway’s proposals on case to case basis. Recently, Board have allowed this dispensation to NWR, SR, and SCR, for example. However, allowing Tech-I for the post of JE as a matter of policy is not feasible of acceptance.

It is hoped that the Federation will appreciate the position.

The Department of Personnel & Training nominates Gazetted Officers as Area Welfare Officers (AWOs) for residential colonies to look after the welfare of Central Govt. employees and their families Area Welfare Officer is only a functional arrangement to provide a link between the Central Government employees residing in various colonies and the concerned civic and other agencies providing service to them. A list of functions of Area Welfare Officer is enclosed. The functions of AWOs are official in nature and are performed by them on honorary and voluntary basis. Only those officers who are willing to function as Area Welfare Officer and can spare time for welfare work will be considered for nomination. The Area Welfare Officers serve as a vital link between the Government and residents in various matters relating to the welfare of Government employees residing in various colonies.

Air India to Pay Up-to-Date Salary to its Employees before Diwali 

On the direction from Union Minister of Civil Aviation Shri Ajit Singh, Air India has decided to clear payment of salary to all its employees for the months of September and October 2012 before Diwali. It will also make up-to-date payment of PLI for all licensed category employees for the months of May and June 2012. The Airline will incur an expenditure of Rs.230 crores for payment of salary and Rs.200 crores for payment of PLI. The balance PLI for non-licensed category employees for the months of May and June 2012 involving an expenditure of Rs.60 crores will be paid by the end of November 2012. PLI has been abolished w.e.f. 1st July 2012.

In terms of instructions issued by DOP&T vide O.M. No.35034/3/2008-Estt.(D) dated 19 May 2009 and further clarifications dated 16 Nov, 2009 & 09 Sep, 2010 on the subject mentioned above, the Competent Authority has approved the grant of First, Second & Third Financial Umradation(s) under MACPS, as the case may be, to Multi Tasking Stall of AFHQ/ISOs with effect from the date mentioned against the officials mentioned at Annexure ‘A’.

Subject: Transfer to lower post under FR 15(a).

The undersigned is directed to refer to this Deparment’s OM No.16/6/2001-Estt (Pay-I) dated the 14th February, 2006, read with OM of even number dated the 4th Januanry, 2007, which clarified that on transfer to the lower post/scale under FR 15(a), the pay of a Government servant holding a post on regular basis will be fixed at a stage equal to the pay drawn by him in the higher grade. If no such stage is available, the pay will be fixed at the stage next below the pay drawn by him in the higher post and the difference may be granted as personal pay to be absorbed in future increments. If the maximum of the pay scale of the lower post is less than the pay drawn by him in the higher post, his pay may be restricted to the maximum under FR
22(1)(a)(3).

I am directed to refer to your Federation's letter No. II/5 dated 2/7/2012 on the above subject and to stae that as per Western Railway's report no instance of withholding of 100 sets of Passes and 100 sets of PTOs have come to notice on Bhavnagar Division. In so far as withholding of 30 sets of Passes and 40 sets of PTOs of a PWI on Vadodara Division is concerned, the application authority has already reduced the penalty to 'withholding of three sets of pass' on 1.3.2012.
