OFFICE MEMORANDUM

Subject: Central Civil Services (Revised Pay) Rules, 2008 - the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.

The undersigned is directed to invite a reference to Rules 5 & 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.

This Ministry issued instructions vide this Departments OM No.10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pie-revised pay scale as a one time measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules 2008.

In view of the benefit extended to Central Government employees as per the aforesaid OM dated 19.3.2012, the issue relating to according of a fresh opportunity to Central Government employees to re-exercise their option to come over to the revised pay scale as per CCS(RP) Rules, 2008 was raised by the Staff side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.

4 The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid OM dated 19.3.2012 bring about a material change in the basis for exercise of option to come over to the revised pay structure in terms of the CCS(RP) Rules, 2008 in respect of employees who are covered under the said OM dated 19.3.2012, the President is pleased to decide that all those employees who are covered under the provisions of the aforesaid OM dated 19.3.2012 may once again be permitted to re-exercise their option to come over to the Revised pay structure.

5. The benefit under these orders for re-exercise of option shall be available for a period up to 31.3.2013. The revised option shall be intimated to the head of the office by the concerned Government employees in accordance with the provision of Rule 6 (2) of the CCS (RP) rules, 2008.

6. All the Ministries and Departments are requested to bring the content of this OM to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.

7. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.

MINISTRY OF FINANCE ‘S ORDERS GRANTING ONE TIME MEASURE INCREMENT ON 1.1.2006 FOR ALL OFFICIALS WHOSE INCREMENT FELL DUE BETWEEN FEBRUARY AND JUNE 2006 is not applicable to the retired employees between January to June,2006 which is great injustice and also for loss of one increment in fixation of pay as well as all consequential retirement benefit compared to other employees although they were on service/ duty as on 01-01-2006 in the following case :-
What about the case of a person whose annual increment was due between Feb to June,2006 ( last increment drawn in Feb- June,2005 ) but retired before the normal date of increment i.e. Feb-June, 2006? Whether such a person is also entitled to grant of one increment on 1.1.2006 since they were in service on that day (01-01-2006)? if not, such employees will be in a great loss compared to other similar category of employees whose increment is in the month of Feb-June 2006 and retired in July, 2006 & onwards as they will get two additional increments on 01-01-2006 & 01-07-2006 and also other consequent retirement benefit.
Although, as per the confederation’s clarification it is APPLICABLE TO ALL GOVERNMENT EMPLOYEES AS ON DUTY ON 1.1.2006 AND WHOSE DATE OF INCREMENT WAS BETWEEN FEBRUARY AND JUNE, 2006 WOULD BE NOW GIVEN AN INCREMENT IN THE PRE-REVISED SCALE OF PAY AS ‘ONE TIME MEASURE’ AND THEN AGAIN REFIXED WITH ANOTHER INCREMENT IN THE NEW PAY ON 1.7.2006. ALL SUCH OFFICIALS WHO’S PAY WILL BE REFIXED W.E.F. 1.1.2006 SHOULD GET ARREARS AND OFFICIALS WHO RETIRED AFTER 1.1.2006 WILL GET THEIR PENSION UPWARDLY REVISED WITH ALL CONSEQUENTIAL RETIREMENT BENEFITS.
Please clarify the matter. If required, the matter may please be taking up again for the benefit of retired employees and also for natural justice.

I offer my sincere thanks to Mr shailen karmakar.

In this connection the following points are submitted for your better understanding of my case:-

a) During the 5th pay commission my date of increment was 14 September based on the senior junior check list, same was upgraded/shifted from September to Jan 05 i.e. 09 month prior.
b) Just after implementation of 6th pay commission the IAP Gujarat has fixed my pay based on 01-01-2006 whereas in the same month my increment was due but same was not taken into account.
c) Now the commission/DOPT has clarified the matter regarding step up of pay of those personnel whose date of increment falls from February to June.
d) No increment has been sanctioned to me after 01-01-2005 and same was sanctioned to me on 01 july 2006.
e) Please clarify the matter if any letter/guide line has been issued by DOPT may also be intimated.

In this connection the following points are submitted in my case -
I joined my duty in the month of January and going to retire in the month of May before the normal date of increment. My friend Joint after one month of my joining i.e. February she got one increment due to Govt. 1 increment order and also she is going to retire in July again she will be getting one normal increment + DA. Just because of one month in joining time and retirement. There are many employees like me are in a great loss compared to other similar category of employees whose increment is in the month of Feb-June 2006 and retired in July, 2006 & onwards as they will get two additional increments on 01-01-2006 & 01-07-2006 plus DA in July and also other consequent retirement benefit.
Please clarify the matter and do Justice to the employees in this matter.

Dear Narender Doshi,
The one additional increment is applicable to all personnel who were due to get it in pre revised scale during Feb to Jun 2006. If you were in service on 01 Jan 2006 and retired subsequently, you are very much eligible for it. You need to give an option and apply earliest so that you derive benefit in terms of P & A,leave encashment, pension,gratuity etc.

Dear Balwant Dahgwal,

As per the orders on change over from 5th CPC scale to 6th CPC scale, you ought to have been given one increment in January 2006 in the pre revised scale on 01 Jan, 2006 and thereafter get fixation of pay in 6th CPC wef 01 Jan 2006.

My dear Indira,
As you have joined in the month of Jan, your next increment was to fall due on 01 Jan of each year.However it would have changed with promotion due the service. Presume, no promotion then it should have fallen due on 01 Jan 2006. You ought to have been given one increment in pre-revised pay scale on 01 Jan 2006 as a normal routine. After having earned the due increment, your pay fixation in 6th CPC should have transited.

Dear sir,
I was in PB-3 and fixed on 1-1-2006 at 25110+7600=32710/- and on 1-7-2006 at 26100+7600=33700/-.
I was promoted in PB-4 on 1-2-2007 and was fixed at 37400+8700= 46100/- thereafter I was not given next increment on 1-7-2007 and I was given next increment on 1-7-2008.ie (17 months later)
Please tell me is it correct and I should not get increment on 1-7-2008 as the date 1st July is fixed for inceremnt for every one.
If I opt pay commission from promotion date will I GET BENIFIT OF ONE MORE increment in PB-4 in 1-7-2007. Please clarify.

I was promoted to the post of section officer 0n 08-11-2005 with DNI on 01-02-2006. I had opted for fixation as per my DNI. But i was fixed earlier as the date of promotion was beneficial. However since now the increment from Feb2006 to June 2006 is granted as a one time measure can i have my pay re fixed as per my DNI .i.e Feb 2006 in the pre revised pay scales of 5th Pay Commission and then get to the new pay scales as per the 6th pay commission which if done would be more beneficial. Kindly clarify.

dear sir, we were promoted to rk of major on 10 jun 2006 but our cdao pune has said that since our pay was fixed from date of promotion hence we won;t be getting the additional increment
