Finmin Orders 2013 : Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay

OFFICE MEMORANDUM

Subject:- Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or after 1.1.2006 in case. inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10)to the existing pay in the pay band and then fixing the pay in the promotional post as per the procedure prescribed therein.

2. In terms of this Ministry’s OM No. 169/2/2000-IC dated 24.11.2000, dealing with the situation whereby both the feeder and the promotional grades were placed in the identical revised pay scales based on the recommendations of the 5th Central Pay Commission, it was provided, inter-alia, that only in cases where it was not found feasible to appropriately restructure cadres in question on functional, operational and administrative considerations, extension of the benefit of fixation of pay under FR 22(I)(a)(1) could be considered on the merits of each case, provided all the conditions precedent for the grant of this benefit were fully satisfied and promotion to the post in question actually involved assumption of higher responsibilities.

3. In view of the provisions which existed prior to 1.12006., the matter has been considered and the President is pleased to decide that in cases of promotion from one post to another where the promotional post carries the same Grade Pay as the feeder post, the fixation of pay in such cases will be done in the manner as prescribed in Rule 13(i) of the CCS(RP) Rules, 2008, provided fixation of pay in such cases was done prior to 1.1.2006 in terms of this Ministry’s aforesaid OM No.169/2/2000-IC dated 24 11.2000.

4. In so far as the persons serving the Indian Audit and Account Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India.

Promotion from Master craftsman to chargeman is promotion to a post carrying higher duties and responsibilities but carrying the same grade pay in Ordnance factories. But it is called placement and the benefit of increment of 3% is not being given it is injustice with mastercraftsman being promoted to the Post of chargeman.

The order is not clear. It may be clarified whether one increment is admissible to those who are promoted in the same grade pay after 1.1.2006.

I was holding the post of UDC and got ACP in the Grade Pay of Rs.4200 and after that I have got 3rd MACP in the Grade pay of Rs.4600/- On 01.7.2010 I have promoted to the post of Asstt. Office Supdt. in the Grade Pay sof Rs.4200/- without any financial benefit/pay fixation. Again on 24.11.12. I am promoted to the post of Office Suspdt in the Grade pay of Rs. 4200 without any financial benefit/pay fixation as I have already drawing higher Grade Pay of Rs.4600/-. Two times I am promoted in the same grade pay of Rs. 4200/- without any financial benefit. The dueal promotions to the Post opn which I am promoted is having higher duties and responsibilities. The Finance Ministry has recently issued orders on promotion to the post having higher dutioes and responsibilities. The said order is not so clear or either my office is not ina position to understand the contents of the said Order.

It may kindly be clarified whether or not I am entitled for one increment of 3% on my dual promotion under the above said Finance Ministry's Order.

I was getting Grade Pay of Rs.5400/- through MACP while holding post of AAO in IA&AD & promoted to the post of AO in the same Grade Pay of Rs.5400/-, Can I get 3% increment now undder these orders, as on promotion of AO I was not given any benefit of increment.

Is this order applicable to the 5th CPC feeder and promotion posts which have been merged in the 6th CPC.
The posts in the scale of 5000-150-8000 and 5500-175-9000 has been merged and placed in the PB-2 9300-34800 in the GP of 4200.
The posts in the scale of 6500-200-10500 and 7450-225-11500 has been merged and placed in the PB-2 with GP of 4600.
The staffs who have got promotion in the 5th CPC from 5000-8000 scale to 5500-9000 scale with assumption of higher charges after 1/1/06, are they eligible to get one increment in the GP of 4200 for the above said promotion? As per 6th CPC pay fixation their promotion to 5500-175-9000 has been ignored.
similarly for the staff who were promoted from 6500-200-10500 to 7450-225-11500 after 1/1/06, were given the GP of 4600. No pay fixation benefit has been given to them in the 6th CPC due to merger of the posts.
kindly clarify whether the above said staff are eligible for pay fixation benefit as per the Min. of Fin. order No.10/02/2011.E.III/A dt.7/1/13?

I was in Grade Pay of Rs.4200/- after 10 years through MACP got Rs. 4600/- . After few months I got promotion to the post Having GP-Rs. 4600/- and was not given any benefit of increment. Pl. Clarify whether or not I am eligible for 3% increment at the time of promotion.

In RPF-Railway Protection Force/ Ministry of Railway, the departmental promote,promoted as Asst.Security Commissioner, Group 'A' Cadre Post- is promoted from the rank of Inspector-Group'C'Cadre Post, and is being given the same Scale of Pay and the same Grade Pay/i.e. Rs.5400/- even though it is treated as promotion and holding higher responsibility and liabilities as Group'A'Cadre Officer.Promotion from Master craftsman to chargeman is promotion to a post carrying higher duties and responsibilities but carrying the same grade pay in Ordnance factories. But it is called placement and the benefit of increment of 3% is not being given on the say that they are already in the higher Scale of Pay and Grade Pay.IN view of the above recent Order of the GOI,can I get this 3% increase from the date of promotion-June,2002 and I have retired in August,2006, after implementation of the VI CPC.

Whether the order (10/02/2011-E.III/A Subjected: the fixation of pay on promotion to a post carrying higher responsibilities and duties but carrying same grade pay) is applicable in cases where promotion on or after 01/01/2006 to a post with higher responsibilities but carrying same grade pay. If it is yes than why it is mentioned in the Para 3 of order 10/02/2011-E.III/A that “provided the fixation of pay in such cased was done prior to 01/01/2006.

If this order is applicable in cases where promotion prior to 01/01/2006 than question arises that the grade pay logic came after implementation of six pay commission that is after 01/01/2006 not prior 01/01/2006.

I think that the order is not clear. Some clarification is needed for the said matter.

Sir,

I got promotion as Assistant in the GP of Rs.2400/- without any financial benefit. Am I eligible for one increment. I have completed 20 years of my services and hence eligible or MACP. Our officers told that if you get one increment, you will not entitle for MACP. Are they doing as per rule or not?

Clarification regarding upward revision of pay scales as result of feeder and promotion posts being placed in an identical revised payscale.

The fifth central pay commission had, as a measure of rationalization, merged some of the pre-revised pay scales and had recommended single replacement pay scales in such cases. These recommendations had been accepted by the Govt. and have been duly notified. This has necessitated the placement of feeder and promotion posts in certain ministries and departments in an identical revised pay scale notwithstanding the fact that such posts were in separate and distinct pay scales eafier.


2 This Department has been receiving a number of proposals from various ministries and departments requesting appropriate up-ward revision of the pay scales of the promotion posts concerned so as to restore the earlier relativities. It is clarified in this context that the mere fact that the feeder and promotion posts in certain ministries and departments have been placed in an identical revised pay scale cannot by itself be adequate justification for placing the promotion posts in the hierarchy in a higher pay scale. Upward revision of the pay scale of posts on this consideration alone is not being accepted as a general policy unless these are other extenuating circumstances that might justify the adoption of such a course of action. What is envisaged in such a situation is that, the affected cadres themselves should be appropriately restructured and the relevant recru itment rules amended so as to reduce the number of levels in the hierachy. This is also the spirit underlying the 5th CPC recommendations relating to the merger of different pay scales.
3 Therefore, ministries/departments should, in the first instance, examine in depth the feasibility of appropriately restructuring the cadres in question. Only in cases where this is not found to be feasible on functional,operational and administrative considerations, only extension of the benefit of fixation of pay under FR 22(i)(a) (i) could be considered on the merits of each case and provided that all the conditions precedent for the grant of this benefit are fully satisfied and promotion to the posts in question actually involve the assumption of higher responsibilities.. Al the cases for exitension of the pay fixation benefit in such cases should be referred to the Department of Expenditure sfor prior approval.

4. Ministries and departments of the Government of India are accordingly requested to review all such cases on a priorty basis in consultation with their Financial Advisers and make available specific proposals for the consideration of this Department, in case this has not already been done. The proposals should contain detailed justification indicating the reasons for the inability of the ministries and departments to restructure the cadres, the nature and functions and responsibillties and establish conclusively that the assumption of higher responsibilities is actually involved.

sir, I am join in drdo for scale 5000-150-8000 in nov. 1999 and got a promotion by assessment board in sep. 2006 in scale 5500-175-9000. My incriment month is nov. and as on nov 2005 my basic pay is 5900. After promotion in sep 2006 I was choice option for fixation in nov. 2006 ( my incriment month ) than after fixation my basic pay in nov is 6375. After 6th cpc fixation department fix at jan 2006 in 5900*1.86 + grade pay 4200. One yearly incriment in july 2006 but not give incriment for promotion due to merger of scale. Also not give acp/ macp after 10 year service in nov 2009. I was got second promotion by assessment board in sep 2011. Kindly give me right fixation in current scenario and also send me a link for OM No. 169/2/2000-IC dated 24/11/2000.

Respected Sir,

I am UDC on 01.01.2006 as my increment was due on October 2006 and according to 6 Pay commission and fitman table I am getting pay of Rs. 8560.00+ GP of Rs. 2400 and promoted to the next higher higher grade that is Assistant on 17.02.2006 with minimum pay of Rs. 9300 + GP of Rs. 4200.
Sir, I am not getting any increment on 2006 and I will get one increment only on July 2007.
Sir, I just want to know this information as early as possible whether it is true or not. sir, i am very thankful to you.

Sir,
I am employee in DOP as PA wef 08-01-1991, and after 21 year of service and after availed II MACP in Gd pay of 4200/- I passed a Departmental exam of Postmaster Gd-1 and joined in PM grade wef 16-06-2012 but not get any financial benifit.
In this order can grant one increment or 3% inhancement in pay.

The Central Civil Services(Revised Pay )Rules, 2008 has brought about a drastic change in fixation of pay on promotion on or after 01.01.2006.The changes are as follows:
Prior to Revised Pay Rules According to Revised Pay Rules
1 1.
FR 22(1)(a)(1)
Pay in the higher post will be fixed at the stage next above the notional pay arrived at by increasing his pay in respect of the lower post by an increment of the lower of post. 1
Rule 13 of CCS(RP) Rules,2008
In case of promotion from one Grade Pay to another in the revised pay structure:
One increment equal to 3% of the sum of the pay in the Pay Band and the existing GP and rounded off to the next multiple of Rs.10 and the Grade Pay of the promotional post will be granted.
It is inherent in Rule 13 of CCS(RP) Rules,2008 that if there is no change of Grade Pay there would be no fixation of pay.
Now, the Government have issued OM No. 10/02/2011-E.III/A dated 07.01.2013 stipulating “Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same Grade Pay”.

Now we may take some example
The hierarchy of Post X in a Organisation is Post Y
Post Pre-revised Scale of Pay Revised Pay Structure
1. X 5000-- 8000 9300—34800 GP 4200
2. Y 5500—9000 9300—34800 GP 4200
The post of Y assumes the duties & responsibilities of higher importance.
The most important point to note is that whether the Ministry/Department have framed new RR after post merger of the two scale of pay. If not (in most of the Department it is “no”. If no, all clarifications issued by the DOPT in MACPS should be read keeping in mind that even in Revised pay structures the Y is the promotional hierarchical post of X and the Grade pay in ACP/MACP can not be more than what is admissible in the case of functional promotion. The X (GP Rs.4200/-) can not skip the Grade pay of Y whose GP is also Rs.4200/-.Please refer to the DOPT’s clarification given to Rly available in CGENews.
1. Promotion/ ACP prior to 1.1.2006
(i) The initial fixation of pay as on 1.1.2006 would be done as a normal case in pursuance of Rule 7 of CCS(RP) Rules,2008 read with MACP Rule(Para) 6 with Grade Pay Rs.4200/-.
(ii) This Grade Pay Rs 4200/- will continue till the MACP scheme became operational i.e.01.09.2008.
After the implementation of MACP w.e.f 01.09.2008 the GP would be Rs.4600/- w.e.f 01.09.2008 as per Para 5 of Annexure-1 of MACP Order (OM dated 19.5.2009).
Para 5 appears to be a special dispensation in respect of promotions earned prior to 1.1.2006 from one scale of pay to another, both of which have the same grade pay in the Revised pay structure.
Promotion/ACP from 1.1.2006 to 31.08.2008 from GP Rs.4200/- to GP Rs.4200/- i.e. from X to Y.
Pay fixation will be done under Rule 13 of CCS(RP) Rules,2008-- No. fixation since there is no
change in Grade Pay.
But the promotion/ACP
will be counted as per Para 8 of
MACP order.
Now, the fixation benefit is (i.e.3% monetary benefit) has been allowed vide MOF, DOE, OM No. 10/02/2011-E.III/A dated 7.01.2013

I was getting Rs.5400/- as Grade pay under MACP scheme from 1.9.2008I was promoted as Audit offficer with higher responsiblities on 18.4.2012 with the same grade pay of Rs.5400. I was not given any increment in the plea that I got one increment on 1.9.2008 under MACP scheme. Does the above clarification given by the Government is applicable to me as Promotion as Audit officer involves higher responsiblities?

iwas in the scale of 5500-9000 after fifth pay commission and on promotion in the same scale to a post carrying a higher responsibility on 1.8.98 i was drawing 7250 in the feeder post. where should i have been fixed on promotion i.e.after one notional increment 7425 and the next stage is 7600. i hereby seek your opinion urgently. thanks

I need a clarification regarding applying in some other department but not getting any solid information. Sir presently I am working in the scale of 9300-34800 wtih Grade pay 4200/-. My present basic is 15210/- and soon to get promoted to next grade of 4800/- GP. Sir after Promotion my Basic is going to be about 16200 and if I get an incriment this july total basic would be around 16810. My question is that am I elleigible for applying a post of lesser grade pay of 4600/- where Total Basic would be still higher about 17140/-. Sir please suggest me the ccs rule for this as everytime higher does not pay higher basic in case of promotees :( Would I get a chance to appear in exams conducted by SSC for 4600 G.P. with total basic 17140 :)
