INDWF published discussion points and the decisions taken in the meeting held on 6th Feb 2014 with MoD... 

INDWF published the detailed outcome of the meeting held on 6.2.2014 with Chairmanship of Additional Secretary (A), Ministry of Defence... The Following demands were discussed and the comments are given:

1. Grant of 2nd /3rd MACP in the grade Pay of Rs.4600/- to the Artisan Staff of Defence Establishments who were granted 2nd ACP in the Chargeman scale of Rs.5000-8000. M of D, Defence Finance raised objections stating that Master Craftsman further line of promotion is Chargeman though both are in same pay. By becoming Chargeman, they will neither get one increment nor fixation of pay benefit but it will be treated as one promotion and counted against 3rd MACP.

However, it was claimed that upto 31.12.2005 MCM was getting Rs.4500-7000 and was part of HS (55%) and therefore, on completion of 24 years of regular service 2nd ACP was granted in Rs.5000-8000. But after 01.01.2006, HS I was created and MCM pay was upgraded to Rs.4200/- Grade Pay (Pre-revised Pay Rs.5000-8000). HS I and MCM became regular promotional grade. Therefore, those who got 2nd MACP they should be granted Rs.4600/- after completion of 30 years. This was agreed and Defence finance approved the claim M of D issued orders in this respect vide their letter No.11 (5)/2009-D (Civ-I) dt 06.02.2014. 

“The matter has been considered in consultation with Defence Finance and it is further clarified that since the post of MCM was not in the hierarchy of Artisan staff cadre upto 31.12.2005, the Highly skilled workers/MCM who were already drawing the pay scale of Chargeman (Rs.5000-80000) viz the promotion post upto 31.12.2005 under ACPs may be considered for further Financial upgradtions, if due, in the next grade pay (Rs.4600/-) in the hierarchy of Grade Pay.”

 According to which, HS or MCM employees got Rs.5000-8000 in ACP after completion of 24 years are now eligible to get III MACP on completion of 30 years of service. For those who have completed 30 years between 01.01.2006 and 31.08.2008 they are not considered due to the reasons mentioned above but a fresh proposal was not made to overcome the problem and to grant Rs.4600/- on 3rd MACP for the Artisan Staff, the model proposal for promotion is indicated below:

From HS I on Promotion will go to MCM and MCM and Chargeman both will be considered for promotion to JWM. All the Directorates under M of D and Three Federations were asked to submit their respective comments to M of D for further action. INDWF agreed and submitted our comments in favour of their proposal.
2. Correlation of the Hourly rate of Industrial workers deployed on piecework system in Ordnance Factories in 6th CPC pay scale w.e.f.01.01.2006. The Demand was agreed to. However the issue of giving retrospective effect to the same will be examined separately. File was cleared by Raksha Mantri and will be cleared by Cabinet shortly.
3. Grant of Departmental Overtime Wages (3 ¼ Hrs on Saturday) to Industrial Employees deployed on Piece Work System. Granting of 3 ¼ Hrs working on Saturdays between 44 ¾ and 48 Hrs to be paid to Piece workers. This will be re-examined.
4. Grant of Hourly rate to the Piece Workers of Ordnance Factories who were granted MACP benefits. Depending upon the decision on Agenda Point No.2 decision on this issue will be taken by DPP.
5. Grant of revised ACP benefits to the Labourers who have completed 30 years of service by granting an one time exemption of Trade Test. The matter will be expedited by holding a meeting with DOP&T.
6. Grant of revised ACP benefits to the erstwhile Group ‘D’ NIES The matter will be expedited by holding a meeting with DOP&T.
7. Revision of Night Duty Allowance w.e.f. 01.01.1996 and from 01.01.2006 in the 5th and 6th CPC rates respectively by implementing court judgments to all employees. The benefit of Court judgments (Jodhpur-CAT, Chennai-CAT) will be considered by Defence Finance expeditiously.
8. Doubling of Risk Allowance for Defence Civilian Employees w.e.f. 01.09.2008 has agreed in the National Anomaly committee meeting. DOP&T while getting approval from cabinet has doubled the rate for all employees including employees of OFB. But OFB employees were already getting the rate of Rs.30/-, Rs.60/-, Rs.120/-, the same approved by cabinet whereas Defence employees are to get Rs.60/-, Rs.120/- & Rs.240/- which has to be referred to cabinet again that would be re-considered.

Implementation of the following Judgment to the similarly placed employees as per provisions of DOP&T OM No.A11019/2/98 AT Dt 03.09.1998.
(i) Grant of Promotional Hierarchy (Govt SLP dismissed in the case of CAT Chandigarh Bench, Judgment on OA No.1038/CH of 2010 The Hon’ble CAT order has been challenged by filing W.P.(C) 4662/2013 in the Hon’ble High Court of Delhi. Hon’ble High Court Delhi granted Stay on Hon’ble CAT order dt 26.11.2012 vide order Dt 26.07.2013 The matter is Sub-judice.
(ii) Placement from HS Grade to HS –I should be ignored for granting MACP (Judgment CAT Principle Bench, New Delhi in the case of employees of 505 ABW, New Delhi referring various Supreme Court Judgments 17 Original Applications filed by Defence Civilian Employees of 515 ABW on the similar issue in the CAT Bangalore have been dismissed by the Hon’ble CAT by a single order Dated 18.09.2013
(iii) Restoration of the opportunity of Chowkidars and Safaiwalas of MES for re-designation as Mate(SS) E-in-C’s Branch vide their letter No. Dt issued orders to re-designate Chowkidars and Safaiwalas those who have passed relevant Trade Test have been allowed to be re-designated as Mates SSK.
(iv) Removal of discrimination and grant of skilled Pay scale of Rs.260-400/950-1500 to Non-Petitioner Valveman in MES (Judgment of Hon’ble CAT Jodhpur Bench in OA No.51/2002 dt 21.07.2003 D (Works-II) considering the matter and expedite the same.
(v) Inclusion of HRA and Transport Allowance etc., for computation of OT Wages under Factories Act 1948 based on the Judgment of Madras High Court. Matter relates to Ministry of Labour & Employment. It is also subjudice in the Hon’ble Supreme court. Hence, the Government has to wait the decision of Hon’ble Supreme Court.
(vi) Implementation of higher pay scale and grade structure for the similarly placed cooks of all Defence Establishments as granted to the cooks of Air Force vide M of D letter No. Air HQ/23064/Cooks/PC-4/444-CC/D(Air-III) Dt 12.11.2013 based on the judgment of Hon’ble Principal Bench CAT, New Delhi. Directions may be issued to cadre controlling Authority to carry out the cadre review of cooks cadre in line with cooks of the Air HQrs.
10 Approval of all Cadre Review proposals of MTS, Durwan, Fireman, Drivers, Storekeeping Staff, Industrial Canteen Staff, Para Medical Staff, Stenographers, DEO, JWM and Clerical Staff, of OFB, DRDO, DGQA, Navy, EME, AOC, Air Force and other Directorates pending at different levels. (i) Cadre Reviews pending with Defence Finance be finalised. (ii) Cadre Review proposal not submitted shall be submitted within one month and settled. (iii) DRDO shall consult staff side Federation before finalization of DRTC Cadre Review.
11 Grant of PRIS to the DRDO Employees at Par with Department of Atomic Energy and ISRO. The proposal of ‘Performance Related Incentive Scheme (PRIS) i.e. 20% incentive to DRDO employees” is under consideration of Ministry of Finance.
12 Revision of Fixed Medical Allowance to the Defence Employees posted at Hard stations/isolated places and also grant of medical reimbursement for impatient treatment for such employees by implementing the judgment of Punjab and Haryana High Court. Matter will be perused with Ministry of Health and Family Welfare to Expedite the decision.
13 Grant of Four Grade Structure to the Ammunition Mechanic or NAD under NAVY Grant of Four Grade Structure to the Ammunition Mechanic of NAD under Navy has been pursued with Ministry of Finance to expedite for an early decision.
14 Grant of Four Grade Structure to the Meter Reader of MES at Par with the Artisan Staff. Matter may be pursued with DOP&T to expedite a decision.
15. Extension of CSD Canteen facilities for retired defence Civilian employees at par with Ex-Serviceman. It was stated that Defence Civilian on retirement are not entitled to CSD facilities. The extension of CSD facility to Defence Civilian employees on retirement has been discussed, in the Executive committee (EC) meeting of the Board of control canteen services (BOCCS) wherein due to various constraining factors, such as shortage of manpower, infrastructure and lack of budgetary support, it was ruled that “STATUS QUO” to be maintained. However, during the meeting, it was insisted that this facilities should be extended with some modifications. Then it was agreed to take up the matter again for review.
16. Revision of Bonus payment ceiling and Gratuity ceiling limit. This is a national issue and to be discussed at higher level/Ministry of Finance.
17. Opening of CGHS Dispensaries in all major cities and reorganization of Hospitals under CGHS in Hill Stations. To be raised with Ministry of Health and Family Welfare.
18. Withdraw DPP-2013 which is against the interest of DRDO and Ordnance Factories. Demand may be examined by Department of Defence Production.
POLICY ISSUES
19. No FDI in Defence Sector. Comments noted
20. No disturbance reduction in the functioning of DRDO by implementing Professor Rama Rao Committee recommendations Comments noted
21. No arbitrary reduction of manpower in the various Army Units in the name of ASEC Report in violation of the Cabinet Secretary’s directions. Instructions in this regard may follow
22. No closure of any Defence units including Military Farms. Comments noted
23. Stop all types of outsourcing/contract and regularize all the existing contract/casual workers. Comments noted.
24 Fill up all posts lying vacant in all the Defence Establishments. JS (P&C) will examine
25. Withdraw New Pension Scheme. Issue has been forwarded to DOP&T and Ministry of Finance on 01.10.2013 & 14.10.2013 and will be further pursued.
26. Grant of Compassionate Appointment 100% as being granted by the Railway Ministry The matter may be taken up with DOP&T at higher level.
27. No reduction of sanctioned strength of the ordnance Factories based on Sourab Kumar Committee Report. Comments noted
28. Regular meeting with the recognised Federations by the M o D and other Directorates should be ensured. Staff side was advised to submit a calendar on the line of action which was submitted on 12.01.2014. Meeting with Federations, regularly holding JCM, M of D, Directorate level JCM III meetings.
29 Three meetings of the Departmental Council (JCM) and four meeting of the JCM –III Level council as per the constitution of the JCM Scheme should be ensured. Timely meetings may be ensured
30. Grant of Trade Unions rights to all the non-gazetted employees working in the Defence Establishments as being given in the case of Railway (Upto to Rs.4200/-) A meeting will be held on receipt of the comments from Federations.
31. Grant of Trade Unions rights to the Employees of Hospitals and Training Establishments under M o D since these Establishments are already recognised as Industry by the Labour Ministry. A meeting will be held on receipt of the comments from Federations.
32. Grant of Trade Union Rights to the Defence Civilian Employees posted at area declared under SRO – 17E A meeting will be held on receipt of the comments from Federations.
33. Settle all the 6th CPC Anomalies and all Cadre review proposals before 7th CPC starts functioning Detailed reply was given in the item No.10.
34. Accept all the terms of reference of 7th CPC submitted by the Staff side of National Council (JCM) to the DOP&T. As being done previously, Staff side may be consulted before submitting the proposal to VII CPC on common issues.
35. Implement the revised comprehensive pay package for the Central Government Employees as on 01.01.2014 National Issue not discussed
36. To consider the demand of merger of Dearness Allowance/Dearness Relief with Basic Pay and Basic Pension and also grant of interim relief. National Issue not discussed

After the meeting, Addl Secretary (A), Chairman of the meeting appealed to the Federations that considering the discussions and decisions taken in the meeting, the Federations may please consider to withdraw their proposed Indefinite Strike action. 

The representatives of the Federations expressed the hope ot get the minutes of the meeting by 11th February, 2014 so as to enable them to take a final decision on the proposed strike. 

Accordingly, the Three Federations after receiving the minutes of the meeting held on 06.02.2014, met on 12.02.2014 and decided to defer the Strike based on the positive approach of M of D in resolving the issues and action taken and submitted a letter to the Defence Secretary, Addl. Secretary M of D to defer the strike during our meeting held with them on 12.02.2014. 

Therefore, the Unions are advised/directed to issue a letter to their Head of organisations about deferment of Indefinite Strike from 17.02.2014. 

Further developments will be informed on these demands.
