Subject:    Implications of overstay while on deputation.



It has been brought to notice of the Government that that even though the terms and conditions of deputation issued by the various, Ministries/Departments/Offices specify the period of deputation, there have been a number of cases of overstay without the approval of the competent authority. A number of proposals for regularization of such overstay are also being received for approval by the Competent Authority. It is necessary to ensure that there is no laxity on the part of the controlling authorities in relieving the deputationist and the deputationist should not go by the presumption that he needs to join his parent cadre only after being formally relieved, by the borrowing department. It has, therefore, been decided that in future all cases of deputation shall be regulated by the following conditions viz.:-

(i) The terms and conditions of deputation shall clearly lay down not only period of deputation as per the Recruitment Rules for the post or as approved by the competent authority but also the date of relieving of the deputationist. No further orders for relieving the officer will be necessary;

(ii) The deputationist officer including those who are presently on deputation would be deemed to have been relieved on the date of expiry of the deputation period unless the competent authority has with requisite approvals, extended the period of deputation, in writing, prior to the date of its expiry. It will be the responsibility of the immediate superior officer to ensure that the deputationist does not overstay. In cases where offices are on deputation on the date of issue of these orders and the normal tenures are getting over in a period of six months, the concerned officers/Organizations may be allowed an extension of not more than one month, on a case to case basis with the approval of the DOPT. That in the event of the officer overstaying for any reason, whatsoever, he is liable to disciplinary action and other adverse Civil/Service consequences which would include that the period of unauthorized overstay shall not count against service for the purpose of pension and that any increment due during- the period of unauthorized overstay shall be deferred, with cumulative effect, till the date on which the officer rejoins his parent cadre.

2. Written consent of the officer concerned shall be taken to the terms and conditions of deputation (inclusive of the conditions in para 1 ibid) before the deputation orders are issued. The contents of these instructions will be conveyed to a1l officers presently on deputation for information/compliance.

3. These instructions will apply to all deputationists including State Government Officers/All India Services officers joining Central Government posts on deputation and to officers proceeding on deputation to State Government/autonomous & statutory institutions/foreign Bodies, etc. .

4. If the borrowing Organisations would like a relaxation from these terms, they should obtain approval of DoPT to it, prior to the start of deputation.'

Subject: Encashment of earned leave along with Leave Travel Concession while in service.

The undersinged is directed to refer to Rule 38-A of CCS (Leave Rules, 1972 regarding encashment of earned leave alongwith LTC while in service which says that Government servants are permitted to encash earned leave upto 10 days at the time of availing Leave Travel Concession subject to the condition that earned leave of at least an equivalent duration is also availed of by the Government servant simultaneously. This Department has been receiving a number of references from various faced by them as the facility of LTC is also admissible while availing Casual Leave.

2. The matter has been examined in this Department in consultation with the Ministry of Finance and it has now been decided to permit Government servants encashment of earned leave upto 10 days at the time of availing LTC without any linkage to the number of days and the nature of leave availed while proceeding on LTC.

3. These orders shall take effect from the date of issue.

4. Formal amendment to the provisions of CCS(Leave) Rules, 1972 are being issued separately.

Subject: Travel entitlement for the purpose of Leave Travel Concession.

The undersinged is directed to refer to O.M. of even No.dated 23rd September, 2008 which says that the travel entitlements while on LTC and official tour / transfer will be the same but no daily allowance shall be admissible for travel on LTC. Subsequently, the Ministry of Finance, vide their O.M. No. 7(!) / E. Coord. / 2008 dated 10th November, 2008, had stipulated that in the case of travel on LTC for those entitled to travel by air, only the cheapest economy fare ticket will be allowed, irrespective of their entitlements on tour. A number of references are being received in this Department to restore the travel entitlements as per the O.M. dated 23rd September, 2008.

2. The matter has been examined in this Department in consultation with the Ministry of Finance and it has been decided to restore the travel entitlements for LTC as stipulated vide O.M. dated 23rd September, 2008. The Ministry of Civil Aviation may bring out a scheme on the lines of LTC 80 for travel by business class. The officers and / or their families amy chose to travel on LTC by any airline provided the face does not exceed the fares offered by NACIL (Air India) under their new LTC schmem for business class.

3. These orders shall take effect from the date of issue.

Subject: CCS (Conduct) Rules, 1964 - Permission to avail of mileage points earned by Government servants on tickets purchased for official tour / visits and acceptance of 'Free Companion Ticket' by Government servants introduced from time to time by various Airlines.

The undersinged is directed to refer to the instructions issued vide this Department's O.M.No. 11013 / 7/ 2008 - Esst.(A) dated 6.10.2008 on the above subject directing that the mileage points earned on account of travel for official tours / visits shall not be used for pruposes of private travel in the form of free companion tickets or other variations thereof by a Government servants or members of his (or her) family and any action to the contrary to these instructions rendered a Govt. servant liable for departmental action. A review of these instructions was done in consultation with the Ministry of Finance and it has been decided to modify the instructions contained in the said O.M.to the extent that the Govt. servants shall be allowed to avail the facility of free companion tickets offered by the airlines for International travel only.

2. These orders shall take effect from the date of issue.

3. All Ministries / Departments are requested to please bring the forgoing to the notice of all concerned for information and necessary action.
