Tamil Nadu govt directs employers to declare holiday on polling day

Tamil Nadu Government on Tuesday directed employers in the state to grant their employees a day’s holiday with wages on April 13 to enable them vote in the Assembly elections.

”It is mandatory on the part of every employer in Tamil Nadu to grant a holiday with wages on April 13,” a Labour Department note here said.

Such a measure was mandatory as per the provisions of Section 135 B of Representation of People Act, 1951.

‘Therefore the employers of all the factories, shops, establishments, commercial establishments, catering establishments, plantations, beedi establishments and motor transport undertakings are required to grant holiday with wages on April 13 to all their employees,” it said.

This also applied to daily wage labourers and casual workers, it added.

Public Holiday to employees to all Industrial, Commercial, Establishments and Shops for the General Election to be held on 13.04.2011.

The Election Commission of India has noticed 13.04.2011 as the day of poll for all the Tamil Nadu Assembly Constituencies.

Section 135B of the Representation of the people Act, 1951 requires that other person employed in any business, trade, Industrial undertaking or any other establishment should be granted holiday with wages in the day of poll. The Section further provides that no deduction or abatement of the wages of any person shall be made on account of a holiday having been granted on the day of poll.

The Election commission in its letter No.78/2011/EPS dated:26.03.2011 has informed that the provisions of Section 135B require that the establishments and Shops shall be closed on the day of poll in the constituency where a General Election is to be held. The Election Commission of India has further registered as an elector, may be serving/ employed in an Industrial undertaking even those electors including casual workers working outside the constituency concerned would be entitled to the benefit of a paid Holiday extended under Section 135b (1) of the representation of the People Act, 1951. According to the Election Commission of India, daily wage/Casual workers are also entitled for a holiday and wages on poll day as provided in Section 135 B of the Representation of the People Act, 1951.

in view of the provisions of Section 135 B of the Representation of the People Act, 1951 and the letters of the Election commission of India referred above, it is mandatory of the part of every employer in Tamil Nadu to grant a holiday with wages on 13.04.2011 to all persons employed by them. Therefore, the employers of all the factories, shops, Establishments, commercial establishments, catering establishments, industrial establishments, Plantations, beedi establishments and motor transport undertakings are required to grant holiday with wages on 13/04/2011 to all their employees including daily wage/casual workers.

The Website at http://www.ccahealth.gov.in shall host information related to Accounts including expenditure & receipts; Details of Grant-in-aid/Utilization Certificate making it easy at the click of the button to know the status of fund released and utilized.

The website would also have user friendly information about General Provident Fund details of employees; Information on Pension cases; Circulars/Notices/Orders of the O/o CCA and Contact details of PAOs, DDOs and other Officials which would facilitate interaction with accounts personnel.

Subject: Level ‘A’ Training Programme at ISTM for U.D.Cs with 5 years’ approved service in the grade (18/04/2011 to 23/05/2011).

The undersigned is directed to inform that UDCs, whose names are given in Annexure I, have been nominated for the Level ‘A’ Training Programme conducted by ISTM w.e.f. ,u>18/04/2011 to 23/05/2011. It is requested that these officials may be relieved of their duties, subject to vigilance clearance and advised to report to Shri Parth Vasaniya, Assistant Director (Co-ordinator) ISTM, Administrative Block, JNU Campus (Old), New Delhi-110067 at 9 A.M. on 18th April. 2011.

2. The performance of the officials in the training, as evaluated and reported by ISTM thereof, may be added in their APARs. No request for withdrawal of nomination either from the Ministry/Department or the officer concerned shall be entertained by this Department or the Institute. As the training of the officials and successful completion is necessary for promotion/regularization, the Cadre Units are requested to ensure that the officials nominated to the above programme are relieved in time.

3. As the aforesaid training includes study tour, officers nominated above may be advised to draw necessary TA/DA advance of Rs. 12,000/- each from their respective Ministry/Department. This amount may be released in Cash only.

4. Confirmation with regard to the participation of the officials along with their respective bio-data (Annexure-II) may please be sent by 11th April. 2011 to Shri Parth Vasaniya, Assistant Director (Co-ordinator), ISTM, New Delhi, with a copy to the undersigned. Charter of demands adopted by the Ministerial Staff Conference held 01.03.2011 at Howrah

AIRF General Secretary Mr.Shiva Gopal Mishra has expressed in the letter to the Secretary of Railway Board that various demands adopted by the Ministerial Staff Conference held 01.03.2011 at Howrah

In the Ministerial Staff Conference, organized by our affiliate – Eastern Railwaymen’s Union on 1st March, 2011 at Howrah, the following demands of the Ministerial Cadre were adopted:-

(1) Fill all the existing vacancies in Ministerial cadre all over the Indian Railways.

(2) Stop treating Ministerial Cadre as a ‘Diminishing’ Cadre.

(3) Stop surrendering of posts arbitrarily.

(4) Withdraw ban on recruitment of Ministerial Cadre.

(5) Fill all the Promotional Quota of Ministerial Cadre.

(6) G.P. Rs. 4800 should be awarded to apex grade Ministerial Cadre at par with Accounts Cadre

(7) Fill all the vacancies of the Office Peons of the administrative offices. 50% of Promotion Quota of Clerical Cadre should be reserved for Office Peons.

(8) Determine ‘yardstick’ of Ministerial Cadre after proper job analysis.

(9) 15% of supervisory posts of Ministerial Cadre should be upgraded to Group ‘B’ posts.

(10) Working atmosphere of the administrative office should be given proper attention. A warm environment gives energy to the workers to do their duties properly.

(11) Arrangements must be made for preservation of old records in a proper manner.

(12) Ample stationeries should be supplied to the offices for smooth running of office work.

(13) Ministerial Staff working at the road side stations should be given proper attention and they should be provided with good working environment, stationery goods and above all manpower transfer policy.

(14) Disparity of grade pay in the case of Stenographers and Typists should be removed immediately.

(15) Grade Pay Rs.2800 of the Rajbhasa Assistant should be enhanced to GP Rs.4200 as in other cadre with like-wise qualification at entry grade.

(16) Administrative high-handedness should be stopped to create congenial working atmosphere.

(17) Extra remuneration should be given to Office Peons for doing duty for extra hours.

(18) A transparent transfer policy for Ministerial Staff of road side stations/depot should be adopted by the administration.

(19) Restructuring of higher grade posts of Ministerial Cadre should be at par with that of Accounts Staff.

(20) Grade Pay of Rajbhasa Assistant in their entry grade should be Rs.2800 instead of GP Rs.2400 since the required qualification is Master Degree.

(21) Higher grade posts of Stenographers should be decentralized so that scope of promotion may be enhanced.

(22) Written examination for Sr. Clerk of Ministerial Cadre should be abolished and promotion may be processed on the basis of C.R.

The Board are requested to consider above-cited demands of the Ministerial Staff sympathetically, so that lakhs of Ministerial Staff working in the Indian Railways, who are the backbone of the Railway administration, can be benefited.

An early action in the matter shall be highly appreciated.
