This refers to Commercial Circular No.59 of 2012 on the levy of service tax on transportation of passengers by Rail in Air-conditioned classes and 1 AC Class. The following has been stated therein:

In case of cancellation of tickets booked by the passengers on or after 01.10.2012, service tax can be refunded by Railways except for the portion of service tax on the amount of cancellation charges retained by the Railways.

This Department has issued instructions vide OM No.38/37/08-P&PW(A), dated 21.5.2009, 11.8.2009, 25.6.2010 & 28.9.2010, OM No.1/19/11-P&PW(E), dated 3.8.2011 and OM No. 1/23/2012-P&PW(E), dated 13.09.2012 for consideration of date of birth/age for grant of additional pension/family pension to old pensioners/family pensioners. Certain documents i.e. PAN Card. Matriculation certificate, Passport, CGHS Card, Driving Licence, Voter’s ID Card and Aadhaar Number issued by UIDAI have been allowed to be accepted in this regard.

Consumer Price Index for Industrial Workers (CPI-IW), August, 2012 

The All-India CPI-IW rose by 2 points in August, 2012 and pegged at 214 (two hundred and fourteen). On 1-month percentage change, it increased by 0.94 per cent between July and August compared with 0.52 per cent between the same two months a year ago. 

The largest upward contribution to the change in current index came from food prices which rose by 1.24 per cent, contributing 1.31 percentage points to the total change. At item level, largest upward pressure came from Sugar, Arhar Dal, Wheat & Wheat Atta, Rice, Potato, Mustard & Groundnut Oil, Milk Buffalo, Banana, Goat Meat, Onion, Medicine (Allopathic) and Private Tuition Fee.

1. The ‘One Rank One Pension’ issue has been raised before both the V and VI pay commissions. 

2. The issue is about the considerable disparity in pension between pensioners that retired pre 1996, between 1996-2006 and post 2006.

3. The tying up of pensions with the last drawn pay is applied universally to both civilian and defence personnel.

4. Since the pay scales were revised by the V and VI pay commissions, the tie up with the last drawn pay had widened the disparity in pensions (as referred in the note)

Civil Aviation Minister Asks the Airline to Make Up-To-Date Payments to Employees 

Air India will pay salaries to all its employees for the month of July 2012 by the 27th of September, 2012. The salaries for the non-licensed category of employees for the month of August 2012 will also be paid by the 29th September, 2012. In addition, the Airline will pay the PLI for the licensed category of employees for the month of May 2012. This will entail an overall expenditure of Rs. 230 Crore.

Rs.2300 crore approved to meet the demands of Ex-servicemen pensioners

The Union Cabinet has approved the recommendations of the Committee headed by Cabinet Secretary for benefits to ex-servicemen on four issues.   The financial implications of the improvements made as per the Cabinet decision on the four items are broadly estimated at Rs.2300 crore per annum.  The details are as follows:

I.One Rank One Pension:
On One Rank One Pension, the demand of the Defence Forces and Ex-Servicemen Associations is that uniform pension be paid to the Defence Forces personnel retiring in the same rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension be automatically passed on to the past pensioners.

The clarifications on the above subject have been sought for by some of the Controllers’ offices, consequent upon change of other educational qualification in revised RR. The following points may be noted, while conducting a typewriting test on Computer.

1. The typewriting test is a qualifying test only at speed of not less than 35 words per minute in English correspond to 9000 KDPH and 30 words per minute correspond to 9000 KDPH in Hindi and average of 5 key depressions for each word on Computer. The test will consist of one paper on running matter of 10 minutes duration. The candidates may repeat the test passage if they finished it before the expiry of the test duration.

Central D.A. likely to be cleared by cabinet on Monday evening

It is all set to approve 7% D.A. for Central employees and pensioners by the cabinet. The cabinet meeting scheduled on Friday, the 21st September has been rescheduled on Tuesday and then advanced to Monday (24/09/2012) evening.

Once approved the total Dearness Allowance payable from 1st July 2012 will be 72% of total pay. Employees are likely to get 3 months arrears in cash and the enhanced pay will be effected from the salary of October 2012. Pensioners are likely to get it with the pension of October 2012.

FM APPROVES RAJIV GANDHI EQUITY SAVINGS SCHEME FOR RETAIL INVESTORS

The  Union  Finance Minister, Shri. P. Chidambaram approved a new tax saving scheme called “Rajiv Gandhi Equity Saving Scheme“(RGESS), exclusively for the first time retail investors in securities market. This Scheme would give tax benefits to new investors who invest up to Rs. 50,000 and whose annual income is below Rs. 10 lakh.

The Scheme not only encourages the flow of savings and improves the depth of domestic capital markets, but also aims to promote an ‘equity culture’ in India.  This is also expected to widen the retail investor base in the Indian securities markets.

Cabinet meeting to consider hike in DA postponed

The meeting of the Union Cabinet, which was scheduled to consider a 7 per cent hike in dearness allowance to 80 lakh central government employees and pensioners, has been put off to next week.

“The Cabinet, CCEA (Cabinet Committee on Economic Affairs) and CCI (Cabinet Committee on Infrastructure) meetings scheduled for Friday, have been postponed,” an official announcement said.

Based on the recommendations of 6th Central Pay Commission, the revised pay structure of Rajbhasha staff of Zonal Railways was notified vide Board’s letter No.PC-VI/2008/I/RSRP/1 dated 11.9.2008 and 19.11.2008. There have been demands regarding improvement in the pay structure of above staff and an item has been raised by both the Federations before Departmental Anomaly Committee also.

No Roll Back of decision on LPG : May increase from 6 to 10 Cylinders per year..!

Government is contemplating to increase the limit of subsidised LPG cylinders to a household from 6 to 10 per year.

No roll back of decsions on diesel, LPG and FDI, said Finance Minister. But there is a chance, contemplates the option of raising the number of LPG cylinders to be made available at subsidised rates from the current 6 to 10 cylinders per year.

An earlier, the Cabinet Committee on Political Affairs (CCPA) chaired by Prime Minister had taken the decisions that supply of subsidised LPG cylinders(14.2 kg) per household to six cylinders in a year at the rate of Rs.399 and need of beyond that would have to be paid at the rate of Rs.746 per cylinder.

Ruling on ‘no work, no pay’ principle

The principle of ‘no work, no pay’ will not apply to employees who were willing to work but not allowed to work by the employers despite valid judicial orders in favour of the workers, the Madras High Court Bench in Madurai has held.

Justice S. Manikumar passed the ruling while dismissing a writ petition filed by Madurai Municipal Corporation in 2004 challenging an award passed by a labour court in 1999 to reinstate a sanitary worker who was dismissed from service in 1995 for unauthorised absence from duty.

Pointing out that the sanitary worker S. Mariappan was reinstated only in 2007, without prejudice to the outcome of the present writ petition, despite the order passed by the labour court, the judge said that he was entitled to back-wages from 1999 to 2007. He could also not be penalised or denied wages for the fault of the Corporation in not reinstating him in service and providing work, the judge added.

‘Reimburse government staff for private treatment’

A central government servant is entitled for reimbursement even if he takes treatment in a private hospital under emergent situation, the TN Bench of the Central Administrative Tribunal has held.

M Mohamed Salia, Deputy Chief Engineer, Southern Railway, while returning home, suffered a heart attack on November 20, 2008. Due to the urgency of the matter, his wife admitted him in the nearest private hospital Frontier Lifeline, as the Railway Hospital was 10 km away from her residence. After a by-pass surgery and necessary treatment, he was discharged on December 12, 2008. He paid Rs.3.10 lakh towards hospital bills.

The 4th meeting of the National Anomaly Committee was held on 5.1.2012 at 2.30 PM at New Delhi. The meeting was chaired by Shri R C Misra, Secretary DOP&T.

The Chairman welcomed all members of Official and Staff Side and expressed the hope that the Committee will be able to resolve the issues through a collaborative process. The Leader of Staff Side in his introductory remarks desired that the issues relating to increasing the frequency of the meetings of the National Council and other fora; increment for those whose date of increment fell between February 2006 to June 2006, benefit of MACP for Loco Drivers should be resolved on a priority basis.

The undersigned is directed to invite reference to para 2 (i) of this Department’s O.M. No.AB-14017/66/2008-Estt. (RR) dated 9th March, 2009, which provides that where all the posts in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay / pay scale, the suitability of the incumbents need not be assessed for granting them the higher replacement scale / grade pay / pay scale, there is also no need for the incumbents to complete any minimum eligibility service in the earlier scale of pay. There will be no change in the inter se seniority of the incumbents in the merged scale which shall be decided based on the general instructions on the subject.

SUBJECT : Restoration of withheld portion of Ordinary Family Pension to widow of ESM in Nepal.

The proposal regarding restoration of withheld portion of Ordinary family pension to the Widow of ESM in Nepal has been under consideration by the Government of India. As per extant provision, ordinary family pension can be divided in the event of a pensioner having more than one wife. Plural marriages are apparently very common in Nepal. Therefore, Record office, Indian Embassy has recommended apportionment of ordinary family pension depending upon the number of wives recorded. PCDS(P) is the pension sanctioning authority and full share of family pension to a claimant is not agreed unless it is established that the other widows whose names are recorded are dead.

Minister of Persmin Shri.V.Narayanasamy informed in Lok Sabha on 22nd August, 2012 regarding the subject of seniority of gazetted officers in Central Services and Central Paramilitary Forces.

Written reply was submitted by the Minister to the above question, The seniority of officers in Central services is fixed as per provisions of statutory recruitment rules applicable to the post. In other cases instructions issued vide this Department’s O.M. dated 11.11.2010 will apply.

Change in designations of Assistants of CSS

When answering in Rajya Sabha to the unstarred question about change of designation of the Assistant and Section Officers of CSS, the Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy said that there was no such agreement between Government and CSS/CSCS associations. In the 57th Ordinary Meeting of the Departmental Council (JCM) of DoP&T, held on 8.5.2010, a demand was raised by the staff side to re-designate the posts of LDC/UDC and Assistant in Central Secretariat. The Official side had expressed its “No Objection” to the proposal. The staff side was asked to come up with their suggestions in this regard. These posts have not been re-designated.

Sale of liquor/groceries to entitled customers of Defence canteens is through Unit Run Canteens (URCs). To stop irregularities, smart cards with confidential PIN (Personal Identification Number) have been introduced so that authorized persons alone can avail canteen facilities. Monetary limits for purchase of goods have been fixed and are strictly being followed. Surprise checks are carried out by the administrative/security staff of the respective canteens.

The below information was given by the Minister of Defence Shri.A.K.Antony in a written reply in Rajaya Sabha regarding the subject of URC in the entire nation as follows...

There are approximately 3730 Unit Run Canteens (URCs) in different States registered with Canteen Stores Department (CSD). Details of the URCs set up in different states is annexed as Appendix.

The URCs are run under the arrangement of the units/formations of Defence Services. They procure items from CSD to sell them to service personnel with a moderate profit.

In the Performance Audit of CSD conducted by C&AG, a recommendation has been made that the URCs should be regarded as retail outlets, integral to CSD. The report of C&AG is under examination of PAC.

Introduction of new Centrally Sponsored Scheme of Pre-Matric Scholarship for needy Scheduled Tribe Students, Studying in Classes IX & X

The Union Cabinet has approved a new Centrally Sponsored Scheme of Pre-Matric Scholarship for Scheduled Tribe (ST) students, studying in Class IX & X.  The decision will go a long way in improving participation of ST students enrolled full time in secondary education in Government schools or in a school recognised by Government or a Central/State Board of Secondary Education, whose parents' annual income does not exceed Rs two lakh. The Scheme will help in minimizing the incidence of dropout, especially in transition from the elementary to secondary stage of education.

The Ministry of Women and Child Development has recently proposed to the State Governments/ Union Territory Administrations on 03.05.2012 to display the list of women and children beneficiaries in every Anganwadi Centre (AWC) in the office of the Panchayat and in front of AWC at regular intervals to check pilferage and ensuring that supplementary nutrition reaches to the right beneficiary. In addition, giving of publicity in newspapers to the effect that such a list has been displayed in Panchayats and Anganwadis has also been advised.

PENSION ISSUES IN MTNL AND BSNL

In Lok Sabha Minister of Communications and Information Technology Shri.Milind Deora said in written reply to the question about the pension benefits for MTNL and BSNL employees on 5.9.2012 that the pensionary benefits to the absorbed employees of BSNL are covered under Rule 37-A of Central Civil Services (Pension) Rules, 1972, and the same are being paid by the Government. The pensionary benefits to absorbed employees of MTNL are being paid by MTNL. MTNL employees Associations/Unions are demanding payment of pensionary benefits by the Government.

Scholarship to Single Girl Child

The University Grant Commission under Ministry of Human Resource Development (Department of Higher Education) provides Indira Gandhi Post-Graduate Scholarship to single girl child for pursuing non-professional courses at post graduate level. The Central Board of Secondary Education also gives scholarship, subject to certain conditions, to the meritorious single girl child for pursuing education at Higher Secondary level. 

This was stated by Smt. Krishna Tirath, Minister for Women and Child Development, in a written reply to the Lok Sabha today.

CBSE MERIT SCHOLARSHIP SCHEME FOR SINGLE GIRL CHILDREN

1. Objective 
The objective of CBSE merit scholarship scheme is to provide scholarships to the meritorious Single Girl Students, who are the only child of their parents; and have passed the CBSE Class X Examination with 60% / 6.2 CGPA or more marks/ grades and are continuing their further school education of Class XI and XII. The scheme is aimed to recognize the efforts of the parents in promoting education among girls and to provide encouragement to meritorious students. As per the approval of the Competent Authority dated 23.07.2012, all children born together are Single Girl Child of their parents.

2. Allocation of scholarship 
The number of scholarships for a particular year shall be variable and shall to awarded to all such "Single Girl Students" who have secured 60% / 6.2 CGPA or more marks / grades in the CBSE Class X Examination in that year.

KVS is not granting MACP Scheme to teachers of KVs...

In Lok Sabha the Minister of Human Resource Development Dr.D.Purandeswari answered to the question of whether the KVS has implemented the ACP Scheme for its teachers, she said in its written reply that KVS has not implemented MACP Scheme for its teachers of KVS.

Additionally she said, “Assured Career Progression (ACP) was recommended by the 5th Pay Commission and the teachers of Kendriya Vidyalaya Sangathan had not opted for this scheme. The 6th Central Pay Commission has recommended Modified Assured Career Progression (MACP) Scheme.  The ACP introduced in the year 1999 provided for grant of two financial upgradation at the interval of 12 and 24 years of continuous regular service. The MACP introduced in the year 2008 provided for grant of three financial upgradation at the interval of 10, 20 and 30 years of continuous regular service”.

Service Charge on Booking of E-Tickets

The Indian Railways Catering and Tourism Corporation (IRCTC) doe not levy any charges on cancellation of e-tickets on account of non-confirmation. A nominal service charge of Rs. 10/- per PNR for e-ticket issued for Sleeper & reserved Second Sitting (2S) and Rs. 20/- per PNR for e-tickets in other classes is charged. The service charge realized is used to meet Administrative cost, Maintenance cost of IT hardware and software, technical manpower costs of service providers, recurring expenditure like rent, electricity charges, internet bandwidth charges, cost for investments in capacity enhancement and also replacement of obsolete IT equipments etc.

New Pension Scheme for Workers without benefit of Formal Pension

There are 6.92 crores members under Employees’ Pension Scheme, 1995 as on 31.03.2012. However, to ensure the welfare of the workers who are not benefited by any formal pension scheme, the Government has announced a co-contributory pension scheme the ‘Swalalamban’ whereby the Central Government would contribute a sum of Rs.1,000 per annum in each New Pension System (NPS) account opened having a savings of Rs.1,000 – Rs.12,000 per annum. The Scheme commenced in 2010-11. The Government will provide contribution for 5 years to the beneficiaries who register in the year 2010-11, 2011-12 and 2012-13 and therefore, the scheme has been extended up to the year 2016-17.

CGEWHO has published the official minutes of the meeting held under the Chairmanship of CEO, CGEWHO at Chennai (Ph II) project on 23.8.2012.

Minutes of the meeting held under the Chairmanship of CEO, CGEWHO at Chennai (Ph II) project on 23 Aug 2012

A meeting under the Chairmanship of CEO, CGEWHO was held in Chennai (Ph II) project site on 23 Aug 2012, wherein 42 beneficiaries were also present (list placed at Annexure I).  During the discussions, following officials of CGEWHO were also present :
a) Sh M Narayanan, Director (Tech)
b) Sh Gagan Gupta, Asst Director (Tech)
c) Col G Chandrasekaran, Project Manager, Chennai (Ph II)

2. The points raised by beneficiaries were discussed as under :
i) Confirmation on completion of all works in all the DUs (37 blocks) between approved 27 blocks and unapproved 10 blocks  by CMDA  – It was explained that all the defect rectification works shall be completed by 31.10.2012, for all blocks notwithstanding the 
receipt of completion certificate from CMDA as well as non deposit of the final payment by certain beneficiaries. 

ii) Certificate on quality certification by a third party quality agency – It was explained that action is in hand towards obtaining a consultancy from a reputed engineering institution towards obtaining quality audit of the works completed.

iii) Clearance Certificate from CMDA for left out 10 blocks – It was informed that work is in hand towards obtaining Completion Certificate for 10 blocks and CGEWHO is monitoring the progress regularly. It was  also  informed that CEO had met the Secretary, Urban Development, Govt of Tamil Nadu also in this regard on 23 Aug 2012.  It is expected that the proposal towards its issuance of  GO shall be forwarded to Govt of Tamil Nadu shortly by CMDA as per the panel approval. 

vi) Interest waiver, 1.5% contingency reserve fund waiver and compensation for delay to be considered – In this regard, it was explained that there is no provision towards waiver of interest as well as compensation for delay as the organisation is functioning on no profit no loss basis and as per the policy of the organisation, it is not feasible to accede to this request.  With regard to the contingency reserve fund, CEO explained that the matter had been taken up with the Governing Council in its 49th meeting held on 3rd
Aug 2012.

vii) Display of time frame for completion in every block – It was agreed that the schedule towards completion of all blocks with regard to defect rectifications shall be displayed at site.

viii) Car parking refund to be made without any further delay for whoever withdrawn – In this regard it was intimated that in the case of beneficiaries who have not been issued with the possession letter, the activity is done simultaneously.  However, with regard to 
the beneficiaries who had already made the payment and  are having the possession letter towards the car parking the issue shall be looked into the decision shall be taken accordingly.

ix) Charging of electricity should be only on transfer of EB Card in the name of allottee and title – In this regard, it was explained that beneficiaries shall have to get the connection of individual DU transfer  in their name as per TNEB Rules. Till that time the charges towards electricity shall have to be paid by the beneficiaries.      Accordingly, it was suggested that action towards  transfer may be taken up by the beneficiaries on a priority basis and PM shall give necessary assistance towards transfer.

x) The safety of electrical wiring and fixing is to be certified by a safety officer  – In this regard, it was explained that TNEB being statutory authority towards giving power connection has already given connection after proper  verification.  No further certification is required.

xi) Physical manpower deployed by the contractor should be checked and recorded. No bogus booking for effecting payment should be allowed  – It  was explained that the payments are released to the contractor, as per contract only on work basis.

xii) CGEWHO and the contractor to change their adamant attitude officials towards resolving problems faced by the allottees to get qualitative and defect free DUs  – All beneficiaries should contact the Project Manager towards handing over/ defect 
rectification etc. as PM is responsible to complete these activities.   On realizing the certain administrative lacunae, CGEWHO has deputed one Asst Director (Tech) from H.O. to be available at site to oversee all the activities so that all requirements are completed positively by 31.10.2012. The progress achieved after  the above arrangement is quite encouraging.

3. It was conveyed that all the DUs shall be handed over and the issue with regard to the defect liability period shall be reviewed again after obtaining the Completion certificate from CMDA, for balance 10 blocks.
