MINUTES OF THE MEETING OF REVISION OF PPOs FOR PRE-2006 PENSIONERS / FAMILY PENSIONERS INCLUDING PRE-1990 PENSIONERS / FAMILY PENSIONERS


MINUTES OF THE MEETING HELD ON 24TH SEPTEMBER, 2012 REGARDING REVISION OF PPOs FOR PRE-2006 PENSIONERS / FAMILY PENSIONERS INCLUDING PRE-1990 PENSIONERS / FAMILY PENSIONERS

A meeting was held on  28th August, 2012 at  11:30  AM in  the Conference Room,  5th Floor,  Sardar Patel  Bhavan, New Delhi under the Chairmanship of Shri Sanjay Kothari, Secretary (Pension, AR&PG) with the officials of 15 Departments/Ministries having maximum number of  unrevised Pension Payment Orders (PPOs) pertaining to  pre-2006 pensioners/family pensioners. In follow-up to that meeting, another meeting of the next 15 Ministries/Departments was taken by Secretary (Pension, AR&PG) on 24th September, 2012 at the same venue. The objective of these meetings was to review the progress made by these Ministries/Departments in the revision of PPOs in respect of pre-2006 pensioners/family pensioners including pre-1990 cases.

3. Opening the discussion, Secretary (Pension, AR & PG) expressed his concern that  cases of revision of PPOs of  pre-2006 pensioners were still pending for a long time. He suggested that a mechanism of weekly/bi-weekly/monthly meetings at the Secretary level in the various Ministries may be evolved to monitor these cases. He also  suggested that pensioners’ associations may be asked to help in obtaining information, wherever necessary, from the pensioner. 

4. Secretary (Pension, AR & PG) then took up the Ministry-wise figures. No one was available from the Ministry of Human  Resources Development, which has the largest number of pending cases.  The representative of Ministry of Coal informed that most of the employees are PSU absorbees and thus these cases are to be done manually which is taking time. Secondly, there are a number of cases where Annexure III had not been received from the banks. Chief Controller (Pension) informed that CPAO will send the information available from the e-scroll of such pensioners/family pensioners whose PPOs have not been revised to the concerned authorities by 30th September. With this information the Annexure III in respect of almost all pensioners/family pensioners belonging to all Ministries/Departments will become available. Ministry of Coal also informed that in many cases the Annexure III sent to the Office of Coal Controller are pending with them. Secretary (Pension) desired that the matter may be taken up the matter with Secretary (Coal). Ministry of Coal also informed that in respect of pre-1990 cases there are limitations of non availability of records. Secretary (Pension) expressed that it must be a problem common to all Ministries/Departments. He urged all to use corroborative evidence available in the permanent service records of the organization such as Pay Bill Registers etc. to overcome this problem. Ministry of Coal agreed that by the end of December 2012 they would be able to revise all pre-2006 PPOs and by March 2013 they would revise all pre-1990 PPOs.

There was no representative from the Ministry of Commerce & Industry, Director General of Supplies and Disposals and Ministry of Environment & Forests. The cases of remaining Ministries/Departments were taken up. Ministry of Agriculture informed that the cumulative records of the 3 departments, viz., Department of Agriculture  & Cooperation, Animal Husbandry and Agricultural Research and Education were not available. He also said that pension records of some pre-2006 pensioners had been destroyed in a fire in one of the Departments. They are trying to reconstitute the records and revise the PPOs as early as possible. Ministry of Textiles also wanted their figures to be segregated from that of D/o Commerce. Ministry of Shipping intimated that majority pending cases were from the Port Cities of Mumbai, Chennai and Kolkata. It was seen that all Ministries/Departments are facing similar problems such as lack of coordination and monitoring of the progress where there are different agencies that possess the PPOs. Secretary (Pension) emphasized that there is a strong need for a monitoring mechanism such as weekly/bi-weekly/monthly meetings. Ministries were also asked to reconcile their cases with the cases available on CPAO’s website.

6. All Ministries/Departments agreed to revising majority of pre-2006 PPOs by December 2012 and pre-1990 PPOs by March 2013. 

7. Secretary (Pension, AR & PG) suggested that the authorities concerned should consult the CPAO whenever they come across a problem. He stated that he would be writing to all the Secretaries concerned asking them to review the pendency regularly.  

8. The meeting ended with a vote of thanks to the Chair.

The Central Civil Services(Revised Pay )Rules, 2008 has brought about a drastic change in fixation of pay on promotion on or after 01.01.2006.The changes are as follows:
Prior to Revised Pay Rules: FR 22(1)(a)(1)
Pay in the higher post will be fixed at the stage next above the notional pay arrived at by increasing his pay in respect of the lower post by an increment of the lower of post.
Revised Pay Rules w.e.f.01.01.2006: Rule 13 of CCS(RP) Rules,2008
In case of promotion from one Grade Pay to another in the revised pay structure:
One increment equal to 3% of the sum of the pay in the Pay Band and the existing GP and rounded off to the next multiple of Rs.10 and the Grade Pay of the promotional post will be granted.
It is inherent in Rule 13 of CCS(RP) Rules,2008 that if there is no change of Grade Pay there will be no fixation of pay. This was the pinching and disadvantageous point. After much persuasion by the staff Associations the Government redressed the grievance by issuing OM No. 10/02/2011-E.III/A dated 07.01.2013 which stipulates the modus operandi of “Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same Grade Pay” by allowing fixation benefit under Rule 13 of CCS(RP) Rules,2008. Many of our friends tend to interpret it as ‘granting an extra increment’ to the officials who got promotion prior to 1.1.2006 in the merged scale of pay. Please note that the OM is applicable to the promotion or financial upgradation occurred on or after 1.1.2006. Please see the following:-

Post Pre-revised Scale of Pay Revised Pay Structure
1. X 5000-- 8000 9300—34800 GP 4200
2. Y 5500—9000 9300—34800 GP 4200
The post of Y assumes the duties & responsibilities of higher importance before and after 1.1.2006 .
The most important point to note is that whether the Ministry/Department have framed new RR after post merger of the two scale of pay. If not (in most of the Department it is “no”. If no, all clarifications issued by the DOPT in MACPS should be read keeping in mind that even in Revised pay structures the Y is the promotional hierarchical post of X and the Grade pay in ACP/MACP can not be more than what is admissible in the case of functional promotion. The X (GP Rs.4200/-) can not skip the Grade pay of Y whose GP is also Rs.4200/-.Please refer to the DOPT’s clarification given to Rly available in CGENews.
1. Promotion/ ACP prior to 1.1.2006
(i) The initial fixation of pay as on 1.1.2006 would be done as a normal case in pursuance of Rule 7 of CCS(RP) Rules,2008 read with MACP Rule(Para) 6 with Grade Pay Rs.4200/-.
(ii) This Grade Pay Rs 4200/- will continue till the MACP scheme became operational i.e.01.09.2008.
After the implementation of MACP w.e.f 01.09.2008 the GP would be Rs.4600/- w.e.f 01.09.2008 as per Para 5 of Annexure-1 of MACP Order (OM dated 19.5.2009).
Para 5 appears to be a special dispensation in respect of promotions earned prior to 1.1.2006 from one scale of pay to another, both of which have the same grade pay in the Revised pay structure.
2. Promotion or ACP from 1.1.2006 to 31.08.2008 from X to Y i.e. from GP Rs.4200/- to GP Rs.4200/-.
Pay fixation will be done under Rule 13 of CCS(RP) Rules,2008-- Previously, no fixation was admissible since there was no change in Grade Pay, but the promotion/ACP was counted as 1 promotion as per Para 8 of MACP order.
Now, the fixation benefit is (i.e.3% monetary benefit) has been allowed vide MOF, DOE, OM No. 10/02/2011-E.III/A dated 7.01.2013.
The Grade Pay of Rs.4600/- is not admissible for actual promotion or ACP from 1.1.2006 to 31.08.2008 from X(GP Rs.4200) to Y(GP Rs.4200). In such cases the Pay will be fixed with 3% benefit with the same Grade Pay of Rs.4200/- ; the promotion/ACP will count as one promotion or financial upgradation and exhaust one ACP/MACP entitlement.

Para 8 which stipulates that:- “Promotion earned in the post carrying same GP in the promotional hierarchy as per Recruitment Rules shall be counted for the purpose of MACPS”
The fixation benefit is (i.e.3% monetary benefit) has been allowed vide MOF, DOE, OM No. 10/02/2011-E.III/A dated 7.01.2013. The promotion/MACP will count and exhaust one MACP.
The ACP granted before 1.1.2006 according to the then hierarchy have to be tallied after 1.1.2006. The number of MACP admissible has to be reassessed and determined keeping in view the new hierarchical posts after 1.1.2006 after the Department/Ministry framed new RR giving higher Grade Pay i.e. Rs.4600 or even more to the erstwhile post which once carried the scale of pay Rs.5500-9000.
4. One of the most important point surfaced from the DOPT’s clarification to rly is that the GP in the 3rd MACP should not be more than the GP which the official would have got had he got three functional promotion in his line of promotion in his cadre.

Sir,
While recruitment my cadre hierarchy was
Rs 5000- 8000( Revised GP 4200)
Rs 5500-9000 (revised GP 4200)
Rs 6500- 10500( revised GP 4600)
Rs 10000- 15200 (revised GP 6600)

I entered into service on 27.7.1986 as Extension officer in the pre revised pay scale of Rs 5000- 8000. Later on I was promoted to post of Industries Promotion Officer in the pre revised scale of 5500-9000/- on 03.01.1995. Again I was promoted to the Post of Assistant Director in the pre-revised scale of Rs.6500-10500/- on 15.04.1998. now as per 6th CPC the pre-revised scale 5000-8000/-& 5500-9000/- has been merged and placed in PB-2 with Grade pay Rs.4200/- and accordingly our Dept. the post carrying the pay scales Rs.5000-8000/- & 5500-9000/- have been merged and re-designated as Industries Promotion Officer with GP 4200/-. Now the Cadre hierarchy is

Rs 5500-9000 (revised GP 4200)
Rs 6500- 10500( revised GP 4600)
Rs 10000- 15200 (revised GP 6600)
Now I have completed 27 years of services, what would be my 2nd financial up-gradation and when?
would there be any claim for financial up-gradation under ACPs in GP 6600/-
