Subject : Suspension of Government Servant – Review of Suspension

As per provisions contained in Rule 10 of CCS(CC&A) Rules, 1965 suspension of a Government servant is valid only for 90 days unless it is extended after review before expiry of 90 days. It has been observed by the MoD D(Vigilance) that the suspension order has been struck down on the ground that the same had not been reviewed by the reviewing authority before expiry of 90 days.

The Department of Pension and Pensioners Welfare, Ministry of Personnel, Public Grievances and Pensions is implementing a web based mission mode project on pensions namely Pensioner’s Portal under the National e-Governance Plan. The Department has also started initiative called SANKALP for channelizing the experience and skill of Pensioners towards meaningful social activities.

The Department is proposing to conduct the next such Awareness Programme for Pensioners on October 08, 2015 at Ahmedabad Medical Association, AMA House, Opp H.K.Arts College. The meeting will be chaired by Shri Devendra Chaudhry, Secretary (P,AR&PG).

Sub: Circulation of Fake order for extension of due date for filing of Audit report and return of Income for Assessment Year 2015-16-regarding

It has been brought to the notice of the Government that a fake order dated 26th September 2015 supposedly under section 119 of the Income-tax Act 1961 under the signature of one Upmanyu Reddy, Under Secretary to the Government of India is in circulation. The fake order extends the due date for filing of audit report under section 119 of the Income-tax Act to 15 October 2015.

There are lot of enquiries about the 7th CPC report submission. Let us examine the following facts.

1) The 7th CPC had issued following statement in July 2015 in its website http://7cpc.india.gov.in/ . Even today the same status is existing.
“Further to the memoranda received from a variety of Organisations, Federations, Groups representing civil employees in the Government of India as also from the Defence Services, the Commission has had fruitful and wide ranging discussions on relevant issues with all stakeholders. Such interactions have now been concluded. Valuable inputs have been received and the work of compilation and finalization of the report is underway, so that the Commission completes its task in the time frame given to it. Accordingly, any future requests for meeting with the Commission will not be entertained.”
This shows clearly that the 7th CPC wanted to present its report on 28th August 2015 itself with no extension of time.

A crucial document containing the signatures of four members, including the chairman and secretary of the 7th Pay Commission was released on the Social Media, creating a buzz. The document, titled “Report of Seventh Central Pay Commission Highlights” contained the seal of the Central Government, stated that it would be submitted on September 1, 2015. The report showed three pages of the document. At the end of it, there were signatures, along with names and designations of four members of the Pay Commission, including the chairman and secretary.

Recently the central government announced the extension of term of 7th pay commission by four months till 31st December 2015. By the time there were news started coming about seventh Pay Commission that it would ask one month extension to submit the report, Unexpectedly the central government itself granted four month extension to 7th central pay commission in its Cabinet Meeting held on 26th August 2015

One day before the announcement made by central government on granting extension to the pay commission, according to PTI news report, Justice A.K.Mathur, Chairman, 7th Pay Commission, said that by the end of September 2015 the Pay commission report would be submitted to the government.

Why the central government granted four month extension when the commission itself if asked one month time?

Though Central Government decided to extend 4 months life of Pay Commission, it appears that it was in the background of negotiations with Armed Forces Veterans for referring OROP issue to CPC. Now in the background of across the table settlement of OROP, Govt too not issued any orders for time extn. CPC Chairman was averse to delaying his report. Comrade R.Elangovan DREU Working President analyses the situation nicely about possibilities of submission before 39.09.2015. I do agree with this assessment. More over the postponement of SCOVA meeting scheduled in September also indicates the probability of submission by end of September. I am reproducing Elangovan’s note for all to study!

As the recommendation and implementation of the 7th Central Pay Commission is eagerly awaited by the central government employees, some points in the recommendations are slightly leaking in..It may not be authentically correct.

According to information from various sources, the Pay Commission may fix the minimum basic pay at Rs. 15000/- and it is assumed that a huge increase in the salaries of the employees cannot be expected. The term of the commission was extended for four months and they are in full swing giving final touches to the report to be submitted to the central government by the end of December 2015.

“The central cabinet has given its approval yesterday to a six percent hike in dearness allowance from July 2015 onwards, for Central Government employees and pensioners.”

Central Government employees and pensioners get two dearness allowance hikes each year. The dearness allowance for the period of months between January to June is given in March; the DA hike for July to December is given in September.

Release of additional instalment of Dearness Allowance to Central Government employees and Dearness Relief to Pensioners due from 1.7.2015 

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has approved release of an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to Pensioners w.e.f. 01.07.2015. This represents an increase of 6 percent over the existing rate of 113 percent of the Basic Pay/Pension, to compensate for price rise.

As per media news, the Cabinet committee in its meeting tomorrow is likely to approve an additional Dearness Allowance for Central Government employees due from July 2015.

The second installment of this year, from July to December 2015, an additional DA is finalized hike by 6% as per the calculations recommended by 6th CPC. Now the Central Government employees and pensioners are getting 113% DA and DR, after the declaration by the Cabinet Committee on DA, it will become 119%.

Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh has said that the Union Government is in favour of doing away with the practice of holding interviews for appointment to junior level posts.

Presiding over a meeting of Principal Secretaries of General Administration Department (GAD)/Personnel from different States and Union Territories here today, Dr Jitendra Singh said that the Department of Personnel & Training (DoPT) has initiated a serious exercise for identifying the posts for which interview for selection can be discontinued and a communique in this regard has been sent to various State Governments, State Public Service Commissions and Staff Selection Commission. He said that this follows the suggestion put forward by the Prime Minister Shri Narendra Modi during his Independence Day address to the nation from the ramparts of the Red Fort.

OROP – Expected Pension hike and Arrears for ex-servicemen

“After the centre’s announcement of implementation, all ex-servicemen are curious to know about their likely increments and arrear in pension revision.”

Despite the fact that the Central Government has announced the implementation of OROP, which has been the long-standing demand of ex-servicemen for more than 40 years now, anti-government protests and rallies continue to rock New Delhi.

The ex-servicemen have made clear their disappointment over certain important demands and expectations related to the OROP, including the amendments in the pension revision, date of implementation, constituting a one-man commission, fixing of the base year, and the case of those who chose to retire early. These are also the reasons why protests have resumed.

One Rank One Pension – Army’s 40 Year Dream Comes True; to be Implemented from July 1, 2014

OROP Scheme : The long-pending demand of the ex-servicemen, for which they have been fighting for decades, has finally been granted.

The Centre has finally decided to implement the OROP. Defence Minister Manohar Parrikar has made the announcement in this regard.

Although it is being generally said that the demand was being made for 40 years, the movement picked up momentum only about 10 years ago. All their protests, to attract the Centre’s attention, have finally succeeded, one must say.

“Six of our demands have been rejected; the government has accepted only one demand – we are not happy, the protests to continue”.

The ex-servicemen’s United Front have said that they are only partially pleased on the announcement made by the government. They have announced that the protests will continue; a massive rally planned on September 12.

The Government has announced the One Rank One Pension scheme for the Ex-Servicemen. This was announced by the Defence Minister Shri Manohar Parrikar here today. The following is the statement of the Defence Minister:

“Government of India respects its Defence Forces and Ex-Servicemen for their valour, patriotism and sacrifices. The Government is proud of their devotion to duty and bravery. Our forces, besides vigilantly and gallantly defending the nation, have displayed exemplary standards of courage and bravery in natural calamities, law and order situations and other difficult circumstances.

One Rank One Pension : A new wave of expectation rises; Announcements expected in 48 hours

“Although there is no official confirmation from the government, the ex-servicemen’s United Front are ready to accept the demand if it comes with a once-every-two-years pension revision, instead of five.”

Implementation of One Rank One Pension : After crossing multiple hurdles the One Rank One Pension scheme is stuck at one final block. The Government has clarified that it was impossible to revise the pension each year. It is ready for a revision once every five years. But, there are talks that the Government would relax its stand and agree to revise the pension once every two years.

“There is no confirmation from the Government side, but if they agree to revise the pension once every two years, we will accept the term” Major General (Retd) Satbir Singh, who is heading the protests, said.

Sources claim that a section of the ex-servicemen are not ready to accept the once-every-two-years revision. They want to call a general body meeting and discuss it.

Months, weeks, and days have gone. The announcement from the government is now expected in 48 hours. But, there is always the question of whether one should or shouldn’t trust these news.

Many wonder why the demand, that had remained pending for years, suddenly gained momentum and force now. Plenty of reasons are also being attributed to it. Here are the two most important ones…

“Revised tables indicating minimum guaranteed pension/ Ordinary Family Pension has been annexed as annexure-A ( Army pensioners), Annexure -B (Air Force pensioners), and Annexure-C (Navy pensioners) to this letter. Pension Disbursing Authorities are hereby authorized to step up the pension/family pension of the affected pre-2006 pensioners where the existing pension being paid to the pensioners in terms of this Ministry’s above letter dated 11.11.2008 as amended, is less than the rate of pension indicated in above said annexure.”

‘The DoPT has, in its newly issued orders, warned the Central Government employees, including defence personnel, of departmental disciplinary action if they choose to take their complaints directly to the ministers or the PM.’

Central Government employees, army officers, and members of the paramilitary forces are directly contacting the concerned ministers, the ministry officials, and the Prime Minister. The Department of Personnel & Training has termed it a “violation of procedures.”

Central Government employees are contacting the ministers, their secretaries, and the Prime Ministers for grievances related to their work. If they want a solution to their grievance, they must contact their senior officer or bring the grievance to the attention of the head of the department. Instead, seeking other means to solve the problem is in violation of the CCS Rules and Instructions. Disciplinary actions will be taken against such violators.

The initial report received at the Confederation CHQ indicates the participation of about 8.5 lakh Central Government employees in today’s general Strike action of the Indian working Class. Earlier endorsing the call of the Central trade Unions, the Confederation of CGE and workers had called upon the Central Government employees to take part in the one day strike to compel the Govt. to withdraw the anti-people and anti-worker neo-liberal policies pursued since 1991.

Appeals to Trade Unions to Reconsider Call for Proposed Strike Tomorrow

Shri Bandaru Dattatreya, the Minister of State(IC) for Labour and Employment held a press conference here today. Elaborating on the initiatives and continuing efforts of the Government to address the issues and concerns of the Trade Unions for the welfare of workers, the Minister said that of the twelve demands of Trade Unions, the Government is positively working on at least nine demands. Shri Dattatreya said that as already assured while taking Labour Law reforms, the Trade Unions will be consulted. In continuation of earlier appeal to Trade Unions on 27th August, 2015, the Minister appealed again to reconsider their call for proposed strike tomorrow in the interest of workers and the Nation.

Inthis context, Shri Bandaru Dattatreya has sent a letter to to striking Trade Unions.

“For the first time, a clause in OROP was openly rejected. The Finance Minister has refused to give annual increment for pensioners like servicemen get.”

“The task of the finance minister is very much like the housewife’s. She has to spend each and every rupee wisely to make sure that there is no cash crunch towards the end of the month,” Finance Minister Arun Jaitley told the reporters during a press meet.

Ex-servicemen have been fighting for the past 78 days demanding the implementation of One Rank One Pension. The finance minister told the reporters, “We are ready to give them OROP, but we cannot give them annual increments like they demand. We can consider revisions once every five years. The 7th Pay Commission will soon submit its report to the Government. If we have to implement their recommendations and the OROP, there will be additional expenses. We’ll have to manage that too.”
