Subject:- Revision of income criteria to exclude socially advanced persons/sections (Creamy Layer) from the purview of reservation for Other Backward Classes (OBCs).

The undersigned is directed to invite attention to this Department's O.M No.36012/22/93-Estt.(SCT) dated 8th September, 1993 which inter alia provided that sons and daughters of persons having gross annual income of RS.1 lakh or above for a period of three consecutive years would fall within the creamy layer and would not be entitled to get the benefit of reservation available to the Other Backward Classes. The limit of income for determining the creamy layer status was raised to Rs. 2.5 lakh vide this Department's OM of even number dated 9.3.2004. It has now been decided to raise the income limit from Rs. 2.5 lakh to Rs. 4.5 lakh per annum for determining the creamy layer amongst the OBCs. Accordingly the following entry is hereby substituted for the existing entry against Category VI in the Schedule to the above referred O.M.Son(s) and daughter(s) of (a)Persons having gross annual income of Rs. 4.5 lakh or above or: possessing wealth above the exemption limit as prescribed in the Wealth Tax Act for period of three consecutive years. (b)Persons in Categories I, II, III and V A who are not disentitled to the benefit of reservation but have income from other sources of wealth which will bring them within the incomelwealth criteria mentioned in
a) above. Income from salaries or agricultural land shall not be clubbed.

in the month of march2009 one person drawing the pay Rs 17000/- in the pay BAND-II (9300-34800) +4200 GRADE PAY AND PEOMOTED/ ASSURE THE CHARGE OF HIGHER GRADE PAY BAND (9300-34800)+ 4600 GRADE PAY ON IST APRIL 2009. WHAT WILL BE THE BASIC PAY OF INDIVIDUAL IN MONTH OF AUG-2009 IN FOLLOWING CONDITION.
1) IF HIS PAY FIXED ON THE DATE OF PROMOTTION I.E. APR 2009
II) IF HE GIVE THE OPTION TO FIX HIS PAY AFTER THE ANNUAL INCREAMENT I.E JULY 2009.
III) WHAT WILL BE THE BENIFIT IF HE GIVE THE OPTION.
PLEASE CLEARIFY THE SUBJECT AT THE EARLIEST.

if a preventive officer(appointment in 1975) in customs got promotion to Superintendent one 1996 and awarded 2nd ACP on 09.08.99 to the scale of 8000-275-13500, again got promotion to Asstt. Commissioner(AD-hoc) in the year 2008, will he entitled to get 3rd MACP. if yes, then to which scale?

Recently DOPT has issued order of reclassisficationg group of post accoridng to the Grade Pay of post. Whether Head Clerk post carrying grade pay of Rs.4200/- is a Group B gazetted pst!

pay of One Group "D" official has been fixed at Rs. 8350/- + Grd. Pay Rs.1800 in PB-1 on 1.1. 2006, now the offical has got 1 to 3 MACP w.e.f. 1.9.08, (Gr.Pay Rs. 1900, Rs. 2000 & Rs. 2400 on 1.9.08) is he entitled to 3 increments or 1 increment plus Gr. pay of Rs. 2400.

I am a head constable in 4th NDRF Bn and presently posted at Arakkonam (TN). I have two children and one of my daughter is studying at residential higher secondary school , kunnamkulam in Kerala. I have been allotted with govt family accommodation at my present place of posting and i am residing with my family.I have not claimed CEA for my daughter. Please clarify whether i am eligible for hostel subsidy for my daughter or not.

I am working in Army Ordnance Corps as a UDC. my pay fixed under 6cpc as on 1-1-06 Rs. 11490+4200 grade pay in Pay Band PB-3 (9300-34400. as per min of fin imentation cell letter the pre-revised pay scale 5000-8000 and 5500-9000 has been merged pay scale 6500-12000 and pay will be fixed as on 1-1-2006 Rs. 12090 +4200 grade pay. But audit authy not satisfied to this letter. please clarified.

in this case pay of the employee Ist will be fixed in the Grade pay Rs. 1900 , IInd will be fixed in the Grade pay Rs. 2000& IIIrd will be fixed in the Grade pay Rs. 2400. Furter he will be benefited fixtation of pay after draw A/I i.e wef 01 JUL 09.

I am a central government employee on the post of divisional accounts officer grade-2 in PB-2 with basic pay 12960+4600 grade pay. I am to join the post of Inspector in Central Excise & Customs with same pay band and grade pay with proper channel. I just want to know how my pay will be fixed and what will be my new basic pay? Am I entitled for transfer TA?

i got promoted as inspector of income tax on 26-09-2008. my basic pay as on 01-04-2010 is 11020/- whereas one junior inspector recruited directly in september, 2009 is get basic pay at 12540/- as on 01-04-2010. this is an anomaly. kindly help me.

I have been selected by upsc in pb-3gp-5400, my previous pay in pb-2 was 16290/-Gp 4800/-, my present office is not intrested to fix my pay by adding 3% increment. they say that you are fresh appointy not promoted, what is the rule in this regard?

If you joined in present post through proper channel, you are not a fresh recurit and your pay will be fixed by adding 3% increment .

i was appointed as a plater at naval dockyard,mumbai in Feb 1981.my basic pay was rs.225/-and on 16/oct/1981,the 3rd pay commission revised my pay scale as a rs.260/-(there is no grade between rs.260 & rs.380).in 1986,i was promoted to the grade of hsk grade I and my basic was rs.380/-.and in march 2006,i get promoted as a charge-man-II.(in naval dockyard,trades of sheet metal workers,black smith,structural fitter were merged as platers).there was no rs.330/- grade in plater trade but the management wrongly offered some individual the same.now their basic pay & Grade is above me even though being my juniors.

I WAS APPOINTED AS FIREMAN-II ON 2001.IN 31.10.2007 PROMOTED AS LDC BY DEPARTMENTAL EXAM. IN 6 CPC 1.01.2006 MY GP IS 1800, ON 31.10.2007 I GOT 1900 FOR LDC WITH 1 INCREMENT. NOW FIREMAN ALSO GOT 1900 GP FROM 01.01.2006. IN THAT CASE MY PROMOTION IS AMENDED AS RE-DESIGNATION, SO MY INCREMENT ALSO RECOVERED FROM 2007 (33 MONTHS). IS IT CORRECT OR NOT?

Sir, I was appointed in a Central Govt Deptt as LDC during 18 May 1989 and got first ACP during 2001. On passing Diploma in Civil Engineering, I got promotion as JE (Civ) wef 22 Jan 2005. As per Govt orders, 2nd financial upgradation under MACP will be granted on completion of 20 years of service. Now, I have completed 21 years qualifying service but my name was not included in the list of MACP of my Deptt. Kindly confirm can I get 2nd MACP in the grade pay of Rs.4600.00. Now my grade pay is 4200.00 pm

I work in dept under Ministry of Finance. Ministry of Communication sanction financdial assistance to its employees participating in Kailash Mansarovar Yatra by way of reimbursement of payment made ot Youth Hostel Asso. of India and fees paid to China and also sanction of 30 days' spl. causal leave vide circular (No. 15-13/89-WL/Sports dt. 31.10.1989). Can I get similar circular issued by Min. of finance to its employees? or the original circular issued by DOPT?
